Application by CKDU-FM Society relating to the broadcasting licence for the English-language community-based campus radio programming undertaking CKDU-FM Halifax.

The licensee proposes to change the location of the transmission site and to amend the authorized contours by changing its antenna's radiation pattern and by decreasing the average effective radiated power from 3,200 watts to 2,640 watts (non-directional antenna with an effective height of antenna above average terrain of 156.5 metres).

The licensee indicated that its current transmission site will no longer be available because it was deemed to be a public safety hazard. The licensee also indicated that, since the proposed site is considerably higher than the current site, there will be secondary benefits to the move such as an increase in the service area as well as in the quality of CKDU-FM's signal within its broadcast range.

The Commission notes that the population will increase from 226,444 to 304,316 within the 3 mV/m contour, and from 335,446 to 371,866 within the 0.5 mV/m contour.

Application by Sex-Shop Television Inc. to amend the broadcasting licence for the national French-language Category 2 pay television programming undertaking to be known as Vanessa in order to allow the service to be available for distribution in the high definition format.

The licensee is requesting that this amendment be valid until the end of the licence term.

This request is consistent with the Commission's approach to high definition specialty services stated in Regulatory framework for the licensing and distribution of high definition pay and specialty services, Broadcasting Public Notice CRTC 2006-74, 15 June 2006 and with the changes announced in Regulatory frameworks for broadcasting distribution undertakings and discretionary programming services, Broadcasting Public Notice CRTC 2008-100, 30 October 2008.

The intervention must be received by the Commission and by the applicant on or before the above-mentioned date. The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. The intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.

Interventions should clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
