Re: Complaint by Quebecor Media Inc. (Quebecor), on behalf of the service The Cave, against Bell

This letter is with respect to the designation of confidentiality made by Bell in connection with the above-noted complaint. Specifically, Bell designated as confidential the following information:

In its 26 May 2011 letter, Bell revised its confidentiality designation to include certain information contained in Quebecor’s submissions, namely:

Bell filed abridged versions with the Commission of the above documents, in which it redacted the information designated as confidential. The information designated as confidential pertains to penetration rates, the affiliation agreement between the parties, as well as wholesale fees.

It is noted that the documents in this complaint were filed prior to the coming into force of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules). Accordingly, consistent with the former practice, the documents related to this complaint were not posted on the web upon receipt.

As of 1 April 2011, the Rules apply to all matters of confidentiality before the Commission, including those filed prior to this date. Section 34(1) of the Rules states that, in broadcasting matters, the Commission may disclose or require the disclosure of information designated as confidential if it is of the opinion that the disclosure is in the public interest.

Bell’s designation of confidentiality, as set out above, has been granted. Accordingly, a copy of this letter and all related correspondence, including the redacted versions provided by Bell, will be added to the public record of the proceeding.
