Dear Mr. Rudock:

On 17 January 2012, Commission staff requested that you file a self-assessment report pertaining to the musical content broadcast during the week of 8-14 January 2012. This was requested to be filed by 30 January 2012. On 28 March 2012, we received the document in question.

In your self-assessment report, you note the following:

Section 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations) state the following:

2.2(8) Except as otherwise provided under a condition of its licence that refers expressly to this subsection and subject to subsection (6), an A.M. licensee, F.M. licensee or digital radio licensee that is licensed to operate a commercial station, community station or campus stations hall, in a broadcast week, devote at least 35% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

2.2(9) Except as otherwise provided under a condition of its licence and subject to subsection (6) an A.M. licensee, F.M. licensee that is licensed to operate a commercial station shall, between 6:00 a.m. and 6:00 p.m., in any period beginning on a Monday and ending on the Friday of that week, devote at least 35% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

 

The information provided in your self assessment report indicates that you may have failed to comply with these provisions of the Regulations.

Please be advised that the Commission may wish to discuss this issue with you further at the 19 June hearing in Gatineau at which you are expected to appear. Please be prepared to do so. No further comment is necessary until then.
