Dear Me Harvey:

On 12 June 2012, Barakatt Harvey s.e.n.c.r.l Société d’avocats filed a procedural request to postpone to another hearing Radio Charlesbourg/Haute St-Charles’ (the licensee) appearance at the 19 June 2012 hearing, announced in Notice of Hearing, Broadcasting Notice of Consultation CRTC 2012-224, 18 April 2012, as amended by Broadcasting Notice of Consultation CRTC 2012-224-1, 11 May 2012 (the Notice of Consultation). According to this request, the licensee requires additional time to finalize its reorganization, which will allow it to resolve the issues identified in the Notice of Consultation.

The Commission has considered the procedural request and has made the decision to deny it. The licensee was notified on 18 April 2012 that its licence renewal application was scheduled on the hearing. Pursuant to subsection 36(1) of the Rules of Practice and Procedure, the Commission notified the licensee that it is required to appear at the hearing on 31 May 2012. A copy of these two notices is attached to this letter.

These two notices were sent to the email address provided by Mr. Stéphane Bergeron, member of the licensee’s board of directors and the person who filed the renewal application 2011-1557-7, as the address where the licensee or its contact-person could be reached. The Commission notes that the licensee is responsible for notifying the Commission of any changes to the licensee’s contact information or to the contact-person representing it.

As set out in its letter dated 31 May 2012, the Commission notes that the licensee will appear at the 19 June 2012 hearing in Gatineau, Quebec, to discuss the licence renewal of CIMI-FM and the instances of apparent non-compliance set out in the Notice of Consultation and to show cause why the licence of CIMI-FM should not be subject to a short-term renewal or mandatory orders and why the Commission should not suspend or not renew the licence. A number of outstanding issues will be discussed at the hearing and the licensee will have the opportunity to present its case to the hearing panel at that time.
