Re: Eastlink and Wightman Part 1 Applications concerning an interim process for service cancelation by a third party

On 13 September 2013, the Commission received separate but related Part 1 applications from Bragg Communications Inc., carrying business as Eastlink (Eastlink) and Wightman Telecom Ltd. (Wightman) concerning third party cancelation notification for a customer’s non-portable [1] services.

In its application Wightman asked that the normal Part 1 procedural timeframes be shortened with Eastlink being directed to file its response by 23 September 2013, and Wightman to file its reply comments by 28 September2013.

In its application, Eastlink requested that the Commission direct Wightman to cease sending cancelation requests for non-portable services to Eastlink while this matter is before the Commission.

Staff is of the view that such a direction would, in essence, be a determination in the matters contained in the Part 1 applications. As such, staff considers it inappropriate to provide such a direction to Wightman at this time.

However, staff agrees that it would be preferable to resolve the issue common to both applications as quickly as possible, and considers that a shortened procedure period would be appropriate for the above noted Part 1 applications.

Therefore, Eastlink and Wightman are to file their responses to the applicable Part 1 application by 7 October 2013. Interested parties may also file interventions by 7 October 2013. Reply comments are to be filed by 10 October 2013. Please note that all documents are to be received, and not merely sent, by these dates.

[1] Non-portable services are those services where a customer transfer does not require any processing through the Number Portability Administration Centre. In essence, these services are television and Internet services.
