Subject: TVS - Application 2014-0010-1 and Confidentiality Designation

On 8 January 2014, the Commission received an application from McCarthy Tétrault LLP (McCarthy) on behalf of China International Television Corporation (CITVC) and its wholly-owned subsidiary, China International Communications Co. Ltd. (CICC), to add The Satellite Channel of Southern Television Guangdong (TVS), a general-interest Cantonese-language service, to the List of non-Canadian programming services authorized for distribution. In this application, McCarthy requested that the Commission conduct an abbreviated process with respect to the above noted application and abridge the 30-day period for answers and interventions, and ten-day period for replies to them.

Commission staff considers that it would be appropriate to consider McCarthy’s application on an expedited basis in the circumstances. Accordingly, the applicant request is approved and the timetable for the process will be as follows:

In addition, Commission staff notes that McCarthy has asked for a copy of a letter Footnote 1 dated 3 August 2013 from the operator of TVS that was submitted as part of the application submitted by 1902868 Ontario Inc (WOWtv) on 9 September 2013 and that resulted in Broadcasting Regulatory Policy 2013-666.

Commission staff notes that WOWtv designated this letter as confidential in section 3 of the application form. However, WOWtv did not provide reasons as to why the disclosure of the information contained in the document would not be in the public interest, as specified in section 32(1) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (Rules of Procedure) or submit an abridged version in accordance with section 32(2).

Accordingly, WOWtv is required to provide its reasons in accordance with section 32 of the Rules of Procedure in support of its designation of the document as confidential, without providing an abridged version, or in the alternative file the letter on the public record, providing a copy to McCarthy, by 15 January 2014.

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
