Re: An application made on behalf of the City of Hamilton with respect to the establishment of a Municipal Access Agreement between the City and Bell Canada and associated matters - Request for Commission decision

Dear Sirs,

On 13 November 2014, Bell Canada requested a decision from the Commission, as provided for in subsection 39(4) of the Telecommunications Act, with respect to the confidentiality of certain documents originally filed by the City of Hamilton (the City) in the context of the above-reference application.  Bell Canada’s request follows a letter dated 23 October 2014 in which Commission staff addressed the disclosure of those documents.

In its reply to Bell Canada’s above mentioned request for a Commission decision, the City indicated that it intended to file on 19 November 2014 the City’s documents in accordance with the directions set out in the 23 October 2014 letter.

Commission staff is asking the City not to file its documents until further directions from the Commission.

Furthermore, it is intended that the Commission will make a determination on the confidentiality of impugned documents based on the record as it presently stands.
