Re: Procedural Letter: Part I application 2015-0051-2 – Application by Bell Média (Québec) relating to a proposal to redirect tangible benefits associated with the television sector in the French-language market (Broadcasting Decisions CRTC 2013-310 and 2014-62)

Dear Mrs. Meloul,

This letter is in response to the above-referenced application by Bell Média (Québec) relating to a proposal for tangible benefits associated with the television sector in the French-language market relating to Commission’s decisions as set out in Broadcasting Decisions CRTC 2013-310 and 2014-62.

  1. Commission staff notes that Bell Média (Québec) (Bell) propose to redirect two million dollars in tangible benefits that are allocated to a project called Théâtre Le Diamant associated with the television sector in the French-language market to six new recipients pursuant to Broadcasting Decisions CRTC 2013-310 and 2014-62. The project Théâtre Le Diamant was approved as a social benefit for the television sector. Bell notes in its application that the largest funding commitment for this project may not be secured and as a result Bell is compelled to request the Commission’s authorisation to redirect this funding to other social tangible benefits initiatives.
    1. Please explain to which extent this potential lack of funding contributed to your decision to submit the present application?
    2. Bell indicates that the sum allocated to L’Activité would be used for the creation, production and exhibition of theatre creations projects in order to extend the accessibility of these projects to a greater audience. Please explain how this initiative would serve the television sector?
  2. Commission staff notes that the tangible benefits approved in Broadcasting Decisions CRTC 2013-310 and 2014-62 were authorized pursuant to the Commission’s policy on tangible benefits that was applicable at the time. However, the Commission announced in Broadcasting Regulatory Policy CRTC 2014-459 (BRP 2014-459) a simplified approach to tangible benefits and determining the value of the transaction that revised the Commission’s approach with respect to the allocation of proposed tangible benefits regarding the television sector and maintained its approach to the allocation of the tangible benefits regarding the radio sector.
    1. Please comment on the appropriateness of requiring Bell to value and allocate the proposed tangible benefits in accordance with BRP 2014-459.
    2. Please comment on the impact and result of applying this regulatory policy on Bell’s proposed tangible benefits in the present application.
