Re: Licence renewal applications 2016-0275-6 (CKIQ-FM Iqaluit) and 2016-0276-4 (CKGC-FM Iqaluit)

Mr. Craig,

In order to pursue the analysis of Northern Lights Entertainment Inc.’s applications to renew the English-language commercial radio stations CKIQ-FM Iqaluit, Nunavut and CKGC-FM Iqaluit, Nunavut, please answer the following questions:

Filing of missing annual returns – Conditions of licence:

  1. In response to staff letter dated 30 March 2016, you indicated in an email dated 15 April 2016 that you will file all of the missing annual returns for CKIQ-FM and CKGC-FM by 31 August 2016.  Please comment on the possibility that the Commission impose the following two conditions of licence:
    1. Condition of licence for CKGC-FM:

      The licensee shall file complete annual returns for the 2010-2011, 2011-2012, 2012-2013, 2013-2014, 2014-2015 and 2015-2016 broadcast years by no later than 30 November 2016.

      Annual returns must cover the broadcast year, which begins on 1 September and ends on 31 August of the following calendar year, irrespective of the accounting or taxation year-end of the licensee. It must include the filing of financial statements, which are reports on the financial condition of an entity. Financial statements must be submitted with the annual return as per the requirements set out in Circular No. 404 and in Broadcasting Information Bulletin CRTC 2011-795 - Filing annual returns for radio programming undertakings. As set out in this information Bulletin, it is the licensees’ responsibility to ensure that all appropriate forms and documentation are included with their annual returns and to contact the Commission if further clarification is required.

    2. Condition of licence for CKIQ-FM:

      The licensee shall file complete annual returns for the 2008-2009, 2009-2010, 2010-2011, 2011-2012, 2012-2013, 2013-2014, 2014-2015 and 2015-2016 broadcast years by no later than 30 November 2016.

      Annual returns must cover the broadcast year, which begins on 1 September and ends on 31 August of the following calendar year, irrespective of the accounting or taxation year-end of the licensee. It must include the filing of financial statements, which are reports on the financial condition of an entity. Financial statements must be submitted with the annual return as per the requirements set out in Circular No. 404 and in Broadcasting Information Bulletin CRTC 2011-795 - Filing annual returns for radio programming undertakings. TANGIBLE BENEFITS – CKIQ-FM

  1. As set out at paragraph 14 of Broadcasting Decision CRTC 2009-103, you are directed to contribute a tangible benefits package amounting to $29,491.56, to be spred equally over a seven-year period, and to be allocated as follows:
    • 3% of the value of the transaction to be allocated to the Radio Starmaker Fund;
    • 2% of the value of the transaction to be allocated, at the discretion of the purchaser, to FACTOR or MUSICACTION; and
    • 1% of the value of the transaction to be allocated to the Iqaluit Music Society.

    You are reminded that the licensee is expected to honour these tangible benefits commitments by the end of the 2015-2016 broadcast year (31 August 2016). 

In your email dated 15 April 2016, you indicated that you have followed up with the involved parties and made arrangements to have all outstanding balances paid in full by 31 August 2016.

Please comment on the possibility that the Commission imposes this commitment by condition of licence for CKIQ-FM as follows:

The licensee shall pay, by no later than 31 August 2016, any outstanding tangible benefits in accordance with CKIQ-FM - Acquisition of assets, Broadcasting Decision CRTC 2009-103, 2 March 2009, as determined by the Commission at paragraph 14 of this decision. The licensee shall also file, by 30 November 2016 and in a form deemed acceptable by the Commission, all related proofs of payment and eligibility.

Deadline to respond and procedure

The information requested herein should be received by the Commission no later than 21 April 2016, failing which your applications may be returned to be completed and resubmitted with the Commission should you wish to pursue this proposal.

It is important to note that in the absence of a response on your part by the specified deadline, the licensee will be in a situation of apparent non-compliance withsection 9(4) of the Regulations which requires licensees to respond to Commission requests for information relating to adherence to their regulatory obligations. 

A copy of this letter and all related correspondence will be added to the public record of the proceeding.
