CJAQ-FM Calgary and its transmitters CJAQ-FM-1 Banff and CJAQ-FM-2 Invermere – Licence renewal and amendment

The Commission renews the broadcasting licence for the commercial radio station CJAQ-FM Calgary, Alberta, and its transmitters CJAQ-FM-1 Banff and CJAQ-FM-2 Invermere from 1 January 2018 to 31 August 2024.

Further, the Commission approves an application to amend the broadcasting licence for CJAQ-FM by deleting its conditions of licence relating to the Oldies music format.

Applications

  1. Rogers Media Inc. (Rogers) filed an application (2016-0933-0) to renew the broadcasting licence for the commercial radio station CJAQ-FM Calgary, Alberta, and its transmitters CJAQ-FM-1 Banff and CJAQ-FM-2 Invermere, which expires 31 December 2017.Footnote 1
  2. Rogers also filed an application (2016-0954-6) to amend the broadcasting licence for CJAQ-FM by deleting the following conditions of licence:Footnote 2
    1. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986, in any broadcast week where at least 90% of musical selections from content category 2 that it broadcasts are selections released before 1 January 1981:
      • in that broadcast week, devote 30% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety; and
      • between 6 a.m. and 6 p.m., in the period beginning on Monday of that week and ending on Friday of the same broadcast week, devote 30% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety.
    1. The licensee shall specify, on the music lists it provides to the Commission, the year of release for all musical selections it broadcasts.

      For purposes of this condition, the terms “broadcast week”, “content category” and “musical selection” shall have the meaning set out in section 2 of the Radio Regulations, 1986.

In support of its application, Rogers indicated that these conditions of licence no longer pertain to CJAQ-FM since the station now operates under a Classic Hits format rather than an Oldies format. It stated that since the station does not devote, in any broadcast week, more than 90% of musical selections from content category 2 (Popular Music) to musical selections released before 1 January 1981, the proposed amendments would not have any impact on the station’s programming.
  2. The Commission did not receive any interventions regarding these applications.

Commission’s analysis and decisions

  1. The conditions of licence Rogers wishes to delete are no longer relevant given the format under which the station now operates. Should the Commission approve Rogers’ request, the licensee would be required to comply with the requirement set out in the Radio Regulations, 1986 that 35% or more of CJAQ-FM’s content category 2 musical selections be devoted to Canadian selections broadcast in their entirety in any broadcast week, and between 6 a.m. to 6 p.m., in any period beginning on a Monday and ending on a Friday of that broadcast week.
  2. In light of the above, the Commission approves the application by Rogers Media Inc. to amend the broadcasting licence for the commercial radio programming undertaking CJAQ-FM Calgary by deleting the above-noted conditions of licence.
  3. In addition, the Commission renews the broadcasting licence for CJAQ-FM Calgary and its transmitters CJAQ-FM-1 Banff and CJAQ-FM-2 Invermere from 1 January 2018 to 31 August 2024.
  4. The licensee shall adhere to the conditions of licence set out in Broadcasting Regulatory Policy 2009-62, as well as to the conditions set out in the broadcasting licence for the undertaking.

Reminder

  1. Pursuant to section 22 of the Broadcasting Act, the broadcasting licence renewed in this decision will cease to have any force or effect if the broadcasting certificate issued by the Department of Industry lapses.

Cultural diversity

  1. The Commission expects the licensee to reflect the cultural diversity of Canada in its programming and employment practices.

Employment equity

  1. Because the licensee is subject to the Employment Equity Act and files reports concerning employment equity with the Department of Employment and Social Development, its employment practices are not examined by the Commission.
