RE:  Follow-up to Telecom Order CRTC 2016-396 and Telecom Order CRTC 2016-448 – Request to extend process deadlines

Dear Madams/Sirs:

The Commission is in receipt of a letter, dated 4 August 2017, from Shaw Cablesystems G.P. (Shaw), requesting an extension to process deadlines set out in the Commission staff letter dated 1 August 2017 for the tariff applications related to the aggregated wholesale high-speed access (HSA) services filed as a follow-up to Telecom Order 2016-396 and Telecom Order 2016-448. Specifically, Shaw requested that the Commission extend the deadline for interventions to 22 September 2017 and the deadline for reply comments to 16 October 2017. In support of its request, Shaw cited regulatory resource constraints.

Shaw also referenced a letter filed by Bell Canada in which Bell Canada had indicated that it would be filing revised versions of the former MTS Inc. cost studies. Shaw submitted that an extension would allow for inclusion of revised cost studies of the former MTS Inc. by Bell Canada within the proposed new deadlines for interventions and reply comments.

The Commission is also in receipt of a letter dated 8 August 2017 from Quebecor Media Inc., on behalf of Videotron G.P., letters dated 9 August 2017 from Bell Canada, TELUS Communications Company (TCC), Cogeco Communications Inc. on behalf of Cogeco Connexion Inc., Bragg Communications Incorporated, carrying on business as Eastlink, and a letter dated 15 August 2017 from Canadian Network Operators Consortium Inc., all supporting Shaw’s extension request.

TCC submitted that it had recently identified a number of areas in its submitted cost study that needed to be updated and revised and that it intended to submit a revised cost study package on 11 August 2017. TCC noted that extending the deadlines for the tariff applications related to the aggregated wholesale HSA services would also provide the interveners with additional time to review former MTS Inc. and TCC’s revised cost studies.

Commission staff considers that, in the circumstances, Shaw’s request is appropriate.

Commission staff hereby informs all interested persons that the procedural dates for the filing of interventions and reply comments regarding the tariff applications related to aggregated wholesale HSA services (outlined above and listed in the attachment) are modified as follows:

A Commission staff letter providing additional information on process concerning requests for information will be sent out in due course.
