RE:  Request for an additional comment period regarding the Part 1 Application filed by the City of Gatineau for a Municipal Access Agreement – Procedural letter

Dear Madams/Sirs:

On February 23, 2018, Bell Canada, Quebecor Media Inc., on behalf of its affiliate, Videotron Ltd., Rogers Communications Canada Inc., TELUS Communications Inc. and Cogeco Connexion Inc. (collectively referred to as the Carriers) submitted their representations to the Commission regarding the Part 1 Application submitted on April 13, 2017, by the City of Gatineau (the City) for the approval of a Municipal Access Agreement (MAA).

On March 5, 2018, the Commission received the City’s reply to the Carriers’ comments. On March 9, 2018, the Carriers submitted a letter to the Commission in which they requested the right to file a response to the City’s reply. The Carriers indicated that the City’s reply included new factual and legal arguments that should have been included in its original application, in violation of the Commission’s Rules of Practice and Procedure (the Rules).

After reading the City’s reply, staff is of the opinion that the Commission would benefit from receiving additional submissions, as proposed by the Carriers. As a result, the Carriers will have until March 27, 2018, to submit their comments, and the City will have until April 6 to file a reply.

Under this additional process, the Carriers shall limit their comments to the City’s new arguments, information and proposals; the City shall limit its reply to the comments put forward by the Carriers.
