Call for comments – Imposition of an administrative monetary penalty on Bell Canada in relation to the processing and granting of access permit applications for support structures in accordance with its National Services Tariff

In Telecom Decision 2021-131, the Commission found that Bell Canada had violated section 24 and subsections 25(1) and 27(2) of the Telecommunications Act in relation to the processing and granting of access permit applications for support structures. The Commission also found that Bell Canada had contravened its National Services Tariff and the Support Structure Licence Agreement between it and Videotron Ltd.

The Commission hereby invites interested persons to comment on whether it is appropriate to impose an administrative monetary penalty (AMP) on Bell Canada and, if so, what the appropriate AMP amount would be.

The Commission states the preliminary view that it would be appropriate to impose an AMP on Bell Canada.

Background

  1. In Telecom Decision 2021-131, the Commission found that Bell Canada had violated clause 2.8 of its Support Structure Licence Agreement (SSLA), included in its National Services Tariff, as well as item 901.3(h) of that tariff. The Commission found that Bell Canada had therefore breached section 24 and subsection 25(1) of the Telecommunications Act (the Act) by requiring Quebecor Media Inc., on behalf of Videotron Ltd. (Videotron) to comply with construction standards that Bell Canada itself does not comply with. The Commission determined, among other things, that Bell Canada’s anti-competitive practices were not consistent with the policy objectives set out in section 7 of the Act.
  2. In Telecom Decision 2021-131, the Commission also found that Bell Canada had granted itself an undue preference and had subjected Videotron to an undue disadvantage, contrary to subsection 27(2) of the Act.
  3. In that decision, the Commission also stated the preliminary view that it would be appropriate to impose an administrative monetary penalty (AMP) on Bell Canada to deter future violations and promote compliance with regulatory requirements.
  4. Accordingly, in light of its findings that Bell Canada violated section 24 and subsections 25(1) and 27(2) of the Act, as well as its National Services Tariff and the SSLA between it and Videotron, the Commission is initiating a separate proceeding to consider the appropriateness of imposing an AMP on Bell Canada for the violations.

General administrative monetary penalties scheme

  1. Section 72.001 of the Act states the following:

    Every contravention of a provision of this Act, other than section 17 or 69.2, every contravention of a regulation or decision made by the Commission under this Act, other than a prohibition or a requirement of the Commission made under section 41, and every contravention of any of subsections 51(1) to (4) and (7), 52(1) to (3) and 53(1) to (3) and (6) of the Accessible Canada Act constitutes a violation and the person who commits the violation is liable

    1. in the case of an individual, to an administrative monetary penalty not exceeding $25,000 and, for a subsequent contravention, a penalty not exceeding $50,000; or
    2. in any other case, to an administrative monetary penalty not exceeding $10,000,000 and, for a subsequent contravention, a penalty not exceeding $15,000,000.
  2. Subsection 72.002(1) of the Act states the following:

    The amount of the penalty is to be determined by taking into account the following factors:

    1. the nature and scope of the violation;
    2. the history of compliance with this Act, the regulations or the decisions made by the Commission under this Act, by the person who committed the violation;
    3. any benefit that the person obtained from the commission of the violation;
    4. the person’s ability to pay the penalty;
    5. any factors established by any regulations; and
    6. any other relevant factor.
  3. Subsection 72.002(2) of the Act states that the purpose of the penalty is to promote compliance with the Act, the regulations, or the decisions made by the Commission under the Act, and not to punish.

Call for comments

  1. In light of the above, the Commission initiates a proceeding and invites interested persons to comment on whether it is appropriate to impose an AMP on Bell Canada and, if so, what the appropriate AMP amount would be.
  2. The Commission’s preliminary view is that it would be appropriate to impose an AMP on Bell Canada. This view is informed by the Commission’s findings that Bell Canada violated section 24 and subsections 25(1) and 27(2) of the Act, as well as the National Services Tariff and the SSLA, and by the impact of Bell Canada’s actions on end-users.
  3. In their interventions, parties should provide supporting rationale and all evidence on which they rely to formulate their position by addressing, among other things, (i) the criteria for a penalty, set out in subsection 72.002(1) of the Act, and (ii) subsection 72.002(2) of the Act.

Procedure

  1. The Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules of Procedure) apply to this proceeding. The Rules of Procedure set out, among other things, the rules for the content, format, filing, and service of interventions, answers, replies, and requests for information; the procedure for filing confidential information and requesting its disclosure; and the conduct of public hearings. Accordingly, the procedure set out below must be read in conjunction with the Rules of Procedure and related documents, which can be found on the Commission’s website at www.crtc.gc.ca, under “Statutes and regulations.” The guidelines set out in Broadcasting and Telecom Information Bulletin 2010-959 provide information to help interested persons and parties understand the Rules of Procedure so that they can more effectively participate in Commission proceedings.
  2. Bell Canada is made party to this proceeding and may file interventions with the Commission by 17 May 2021.
  3. Interested persons who wish to become parties to this proceeding must file an intervention with the Commission regarding the above-noted issues by 17 May 2021. The intervention must be filed in accordance with section 26 of the Rules of Procedure.
  4. Parties are permitted to coordinate, organize, and file, in a single submission, interventions by other interested persons who share their position. Information on how to file this type of submission, known as a joint supporting intervention, as well as a template for the accompanying cover letter to be filed by parties, can be found in Telecom Information Bulletin 2011-693.
  5. All documents required to be served on parties to the proceeding must be served using the contact information contained in the interventions.
  6. Bell may file a reply to interventions with the Commission by 1 June 2021.
  7. The Commission encourages interested persons and parties to monitor the record of this proceeding, available on the Commission’s website at www.crtc.gc.ca, for additional information that they may find useful when preparing their submissions.
  8. Submissions longer than five pages should include a summary. Each paragraph of all submissions should be numbered, and the line ***End of document*** should follow the last paragraph. This will help the Commission verify that the document has not been damaged during electronic transmission.
  9. Pursuant to Broadcasting and Telecom Information Bulletin 2015-242, the Commission expects incorporated entities and associations, and encourages all Canadians, to file submissions for Commission proceedings in accessible formats (for example, text-based file formats that enable text to be enlarged or modified, or read by screen readers). To provide assistance in this regard, the Commission has posted on its website guidelines for preparing documents in accessible formats.

  11. Parties who send documents electronically must ensure that they will be able to prove, upon Commission request, that filing, or where required, service of a particular document was completed. Accordingly, parties must keep proof of the sending and receipt of each document for 180 days after the date on which the document is filed or served. The Commission advises parties who file or serve documents by electronic means to exercise caution when using email for the service of documents, as it may be difficult to establish that service has occurred.
  12. In accordance with the Rules of Procedure, a document must be received by the Commission and all relevant parties by 5 p.m. Vancouver time (8 p.m. Ottawa time) on the date it is due. Parties are responsible for ensuring the timely delivery of their submissions and will not be notified if their submissions are received after the deadline. Late submissions, including those due to postal delays, will not be considered by the Commission and will not be made part of the public record.
  13. The Commission will not formally acknowledge submissions. It will, however, fully consider all submissions, which will form part of the public record of the proceeding, provided that the procedure for filing set out above has been followed.
