This application form is to be used for Canadian program certification of Live Action and Continuous Action Animated productions (including domestic productions and international co-ventures).

Where more than 50% of the program duration consists of animated content, please complete Form 205 - Animation instead.

Refer to the Guide to the Canadian Program Certification Application Process (the Guide) which will assist in the completion and filing of this application form. The individual section numbers in this form correspond to those specified in section 10 of the Guide.

1. Conditions for certification

1.1

The following four requirements are mandatory in order for the Commission to process your application:

  1. The principal photography has started.
  2. All key creative personnel are under signed contract.
  3. The committed budgets are in place.
  4. The production company is owned and controlled by Canadians.

1.2 Licensee

APPENDIX 3 - Proof of citizenship:

Please submit Appendix 3 – Proof of citizenship at section 15 of the form. Proof of citizenship is required for all producer and producer personnel as well as all key creative positions for Drama productions (categories 7a) to 7g)), which may be eligible to obtain a 150% time credit. Proof of citizenship may be required for any and all other applications. Please refer to the Guide, section 10, “8.0 Key and Non-Key Creative Production Personnel Citizenship” for more information.

Proof of citizenship is required by all individuals fulfilling the following roles:

  • All producer personnel (all producers indicated in section 7 of the form)
  • Key and non-key creative production personnel (all personnel indicated in lines 8.1 - 8.6 of the form)
  • 1st and 2nd Lead performers (lines 8.8i. and 8.8ii. of the form)

Other categories

12 & 13) Interstitials & Public Service Announcements: Canadian certification will not be issued for these program categories given that they are less than 5 minutes in duration. For more details, please refer to Broadcasting Regulatory Policy CRTC 2010-808. Productions that meet the criteria for Canadian certification applicable to longer programs will be considered as Canadian programs without certification. Applications for certification of such productions are not required, unless specifically requested by the Commission.

Service costs

Service costs include all costs that are incurred for services provided in respect of the making of the production. This includes: costs for development, story, music rights, non-key creative personnel, all producer positions (other than producer and co-producer), production staff, all production labour, all rentals, transportation, shipping, customs and communications, animals, video studio facilities, video remote technical facilities, second unit crew, completion guarantee, unit publicity and amortization (in the case of a series).

The determination as to whether a service cost item is Canadian or non-Canadian is based on the citizenship (or date of landing for landed immigrants who are not yet Canadian citizens) of the person whose account the cost was incurred, or of the person providing the service. For example, if costs are incurred on account of a Canadian citizen or landed immigrant, travelling on production-related business to a location, whether inside or outside Canada, all of the costs incurred on account of this person's travel, including food and lodging while traveling and on-location, would be considered Canadian costs since they were incurred on account of a Canadian citizen or landed immigrant. However, if these same costs were incurred in respect of a non-Canadian, even if they were incurred in Canada, they would be considered non-Canadian expenditures.

In the case of services provided by an incorporated company, the company must have: a Canadian business in Canada, a Canadian address, and be owned and controlled by a Canadian, in order for the cost to be considered Canadian.

9.3

Service costs

Service costs include all costs that are incurred for services provided in respect of the making of the production. This includes: costs for development, story, music rights, non-key creative personnel, all producer positions (other than producer and co-producer), production staff, all production labour, all rentals, transportation, shipping, customs and communications, animals, video studio facilities, video remote technical facilities, second unit crew, completion guarantee, unit publicity and amortization (in the case of a series).

13. Advertising declaration

Advertising Material

Advertising material, infomercials, as well as promotional and corporate videos are not eligible for Canadian program certification. Refer to the CRTC Circular No. 350, Public Notice CRTC 1994-139 and Broadcasting Regulatory Policy CRTC 2010-808 for the definition and broadcast guidelines for “advertising material” "infomercials" and "public service announcements". These documents are available on the Commission website.

Advertising material includes any form of endorsement, message, advertisement, solicitation, product review, sponsorship (beyond corporate name/logo) or the use of addresses, telephone numbers or website addresses, where the purpose of the endorsement, message, etc. is intended, directly or indirectly, to sell or promote a product or service, etc.

Where it can be demonstrated that within the mention or display of a product or service there is clearly no intention to sell or promote the product or service and that the mention or display is necessary for the “bona fide” information reporting of the subject matter in the program, the mention or display will generally not be considered advertising material, (e.g. an unbiased, objective product review or “expert” commentary in the context of information programming).

However, (a) where there are elements within the discussion or display of the subject matter in the program which, directly or indirectly, serve to sell or promote a product or service or (b) where the presentation of the subject matter and its relationship to the products or services advertised during the commercial breaks is such that the impact of the commercial break is significantly enhanced by the subject matter in the program, the entire program segment related to the product or service may be considered advertising material. This is particularly the case where the provider of the product or service is also a sponsor of the program, an advertiser in the program’s commercial breaks or provides products or services to the production in exchange for commercial exposure on the program.

It is the responsibility of the broadcaster, as the licensee, to ensure that any advertising material included in a production or any episodes thereof is identified. All advertising must be logged as advertising and will be counted as part of any maximum amount of advertising per clock hour currently permitted. The terms “advertising material” and “commercial message” are defined in section 2 of the Television Broadcasting Regulations, 1987 as amended from time to time.
