Following a Public Hearing in Halifax on 28 May 1985, the Commission approves the application by Eastern Cable Limited for a licence to carry on a broadcasting receiving undertaking to serve Arnold's Cove by distributing the signals of the Canadian Satellite Communications Inc. (CANCOM) network and other broadcasting services. The Commission will issue a licence expiring 31 March 1990, subject to the conditions of licence specified in this decision and in the licence to be issued.

The boundaries of the authorized service area will be specified in a schedule which will be appended to the licence.

In addition to the priority services required to be carried by regulation, the Commission approves the carriage of the following optional services: CHCH-TV Hamilton, CITV-TV Edmonton, WJBK-TV (CBS), WDIV (NBC), WXYZ-TV (ABC) and WTVS (PBS) Detroit, Michigan, to be received via satellite from CANCOM, and CBFT Montreal, to be received via satellite.

The licensee is authorized to carry the signal of the Atlantic Satellite Network service (ASN) subject to the condition that the signal be distributed on an unimpaired channel of the basic service.

The licensee is also authorized to distribute the CBC Parliamentary Television Network (English-language) on a special programming channel. Such authority will remain in effect only as long as no advertising material is included in this special programming service.

This applicant has not applied to distribute the French-language television service (TCTV) available from CANCOM. The Commission encourages the applicant to undertake a survey of the community during the first year of operation to determine the need for this service. Should such interest be expressed, the applicant will be expected to apply accordingly. Members of the community may also wish to advise the Commission of their interest.

The Commission approves, as a condition of licence, the proposed maximum monthly subscriber fee of $19.50 and a maximum installation fee of $46.00.

The Commission notes that the authorized maximum monthly subscriber fee includes the pass-through fee of $4.90 to be paid by the licensee to CANCOM for the provision of six signals. Approval of the pass-through fee, however, is subject to the requirement that only the actual pass-through fee is charged to subscribers, and only at such time as they receive the CANCOM signals.

The licence is subject to the condition that the licensee own and operate, as a minimum, the local head-end, the amplifiers and the subscriber service drops.

|
The Commission will issue a licence to the applicant where it is in receipt of written notification from the Department of Communications, within two months of the date of this decision, that it will issue a Technical Construction and Operating Certificate. No licence will be issued if the Commission does not receive this notification within said period, or such further period as the Commission may, upon receipt of a request for extension before the expiry of the two months, deem appropriate under the circumstances.

It is a condition of licence that the authority granted herein be implemented within four months of the date of receipt of written notification from the Department of Communications that it will issue a Technical Construction and Operating Certificate or such further period as the Commission may, upon receipt of a request for extension before the expiry of the said four months, deem appropriate under the circumstances.
