Following a Public Hearing in Moncton, New Brunswick on 25 January 1988, the Commission approves the application by North East Cablevision Ltd. for a licence to carry on a broadcasting receiving undertaking to serve Belledune. The operation of this undertaking will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations).

The Commission will issue a licence expiring 31 August 1990, subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.

The Commission notes that although the applicant wishes to distribute pay television and specialty services, it proposes to carry only two services received from the CANCOM network and has asked to be relieved from the requirement of section 23 of the regulations.

In considering the applicant's request, the Commission notes that North East Cablevision Ltd. will not own a head end at Belledune and will receive all of its programming services from North East Cablevision Ltd.'s Class 1 Bathurst cable system which distributes only two CANCOM services, namely WJBK-TV (CBS) and WTVS (PBS) Detroit, Michigan.

In light of the above, the Commission approves, by condition of licence, the licensee's request and accordingly, pursuant to section 23 of the regulations, the applicant is not required to distribute four CANCOM services.

Further, in view of the above-mentioned distribution arrangement, pursuant to section 4 of the regulations, it is a condition of licence that the applicant not be required to own and operate a local head end at Belledune.

The Commission acknowledges the applicant's plans for the development of a community channel and encourages it to promote community interest and access to this channel.
|
|
It is a condition of licence that the authority granted herein be implemented within twelve months of the date of this decision or such further period as the Commission may, upon receipt of a request for extension before the expiry of the said twelve months, deem appropriate under the circumstances.
