Pursuant to Public Notice CRTC 1989-120 dated 1 November 1989, the Commission approves the application to amend the broadcasting licence for CIBL-FM Montreal by increasing the effective radiated power from 10 watts to 221 watts, by changing the frequency from 104.5 MHz (channel 283) to 101.5 MHz (channel 268) and by relocating the transmitter from the west tower of the Olympic Village to the mast of the Olympic Stadium.
In Decision CRTC 88-830 dated 2 December 1988, the Commission approved a change in frequency from 104.5 MHz (Channel 283LP) to 104.7 MHz (Channel 284A), by increasing the effective radiated power from 10 watts to 315 watts, and by relocating the transmitter from the west tower of the Olympic Village to the mast of the Olympic Stadium. Subsequent to this decision, the Department of Communications (DOC) informed the Commission that, although the application is technically acceptable, DOC could not issue a Broadcasting Certificate because Transport Canada had advised that its analysis of the compatibility of the approved frequency (104.7 MHz) with aeronautical navigation services (NAV/COM) operating at Dorval airport indicated a high potential for interference. The technical parameters proposed in the present application constitute one of the options proposed following a subsequent joint NAV/COM compatibility study conducted by DOC and Transport Canada.
The Commission received interventions from Radio-Diffusion Michel Mathieu Inc. and Diffusion Power Inc. opposing the request to change CIBL-FM's frequency on the grounds that the frequency 101.5 MHz (channel 268) is currently allocated to Saint-Jean-sur-Richelieu. Citing the potential for interference from heavy air traffic in the area, the interveners also objected to DOC's proposal to change the frequency allocated to Saint-Jean-sur-Richelieu to 104.1 MHz (channel 281A). In reply, the licensee stated that frequency 101.5 MHz was selected in consultation with DOC. Moreover, the licensee pointed out that frequency 101.5 MHz (channel 268) is the only one available to CIBL-FM that can be operated at technical parameters equivalent to those previously approved in Decision CRTC 88-830. The licensee also noted that DOC approved the use of frequency 101.5 MHz (channel 268) for CIBL-FM because it was satisfied that an equivalent frequency, namely 104.1 MHz (channel 281), could be used as a replacement in Saint-Jean-sur-Richelieu.
The Commission sought to obtain a definitive assessment of the replacement channel/frequency with regard to its compatibility with aeronautical NAV/COM services. However, DOC advised the Commission that Transport Canada could not provide such a determination until precise technical parameters and other details are known for any future proposal to establish an FM transmitting undertaking at Saint-Jean-sur-Richelieu.
Having considered all of the factors related to this application, the Commission is satisfied that approval of the change of CIBL-FM's present frequency is in the public interest.
