Following a Public Hearing in the National Capital Region beginning on 21 November 1989, the Commission approves the applications by Câblevision du Nord de Québec Inc. for licences to carry on broadcasting receiving undertakings to serve Dobie and King Kirkland. The operation of these undertakings will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations). The Commission will issue licences expiring 31 August 1994, subject to the conditions specified in this decision and in the licences to be issued.

The Commission received an intervention from the Canadian Broadcasting Corporation indicating that it had not granted the applicant permission for the distribution of CBMT Montreal, received via satellite. In accordance with the terms of the "Lists of Part III Eligible Satellite Services", carriage of the CBC English- and French-language satellite television services is authorized only if the applicant has entered into the necessary contractual arrangements with the CBC. Accordingly, in the absence of such arrangements, the Commission expects the applicant not to distribute CBMT in order to comply with the regulations.

The Commission acknowledges the intervention from Mr. Fred Lang, President of Fred Lang Television Ltd., licensee of the cable undertaking serving Kirkland Lake, a neighbouring community to King Kirkland. The intervener opposes the application to carry on a cable system at King Kirkland on the grounds that the proposed area represents a natural extension of its Kirkland Lake undertaking and states its willingness to serve the King Kirkland area. The Commission has noted the applicant's reply thereto and further notes that the intervener has not submitted an application to provide service to King Kirkland despite the Commission's call for applications for the extension of cable service to unserved localities in Ontario (Public Notice CRTC 1989-48 dated 18 May 1989). The Commission is satisfied that approval of this application will enable residents of King Kirkland to receive cable service at the earliest possible date.

It is a condition of these licences that construction of these undertakings be completed and that they be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.

The Commission notes that competing applications by Clear Crest Cable TV Limited to operate cable undertakings in Dobie and King Kirkland, announced in CRTC Notice of Public Hearing 1989-11 dated 25 September 1989, were withdrawn before the Public Hearing.
