AMENDMENT TO THE SPECIALTY SERVICES
|

REGULATIONS, 1990"ADVERTISING MATERIAL"
|
In Public Notice CRTC 1994-14 dated 16 February 1994, the Commission called for comment on a proposed amendment to the Specialty Service Regulations, 1990, the purpose of which is to provide consistency between the definition of "advertising material" contained in these regulations and that contained in the Television Broadcasting Regulations, 1987.
|
|
No comments were received by the Commission on this matter. Accordingly, the Commission has enacted the amendment attached to this notice. It was registered on 15 April 1994 (SOR/94-304) and came into force on that date. The amendment was published in the Canada Gazette Part II on 4 May 1994.

BROADCASTING ACT

Specialty Services Regulations, 1990, amendment
|
|
WHEREAS, pursuant to subsection 10(3) of the Broadcasting Act*, a copy of a proposed amendment to the Specialty Services Regulations, 1990**, substantially in the form set out in the schedule hereto, was published in the Canada Gazette Part I on February 26, 1994 and a reasonable opportunity was thereby given to licensees and other interested persons to make representations to the Canadian Radio-Television and Telecommunications Commission with respect thereto;

THEREFORE, the Canadian Radio-television and Telecommunications Commission, pursuant to subsection 10(1) of the Broadcasting Act*, hereby amends the Specialty Services Regulations, 1990, made on January 25, 1990**, in accordance with the schedule hereto.

SCHEDULE
|
|
1. The definition "advertising material" in section 2 of the Specialty Services Regulations, 1990 is revoked and the following substituted therefor:
|
|
"advertising material" means any commercial message, public service announcement, or programming that promotes a station, network or program, but does not include
|
|
(a) a station or network identification,
|
|
(b) the announcement of an upcoming program that is voiced over credits, or
|
|
(c) a promotion for a Canadian program to be broadcast by a licensee, notwithstanding that a sponsor is identified in the title of the program or is identified as a sponsor of the program, where the identification is limited to the name of the sponsor only and does not include a description or representation of the sponsor's products or services or any attributes of the sponsor's products or services; (matériel publicitaire)

EXPLANATORY NOTE
(This note is not part of the Regulations.)
|
|
This amendment provides that promotions for Canadian programs, including those where only sponsorship credit is given or only identification of a sponsor is made, are not considered to be advertising material, thus are excluded from the calculation of the allowable maximum of advertising material that may be broadcast.
