The Commission has received the following application:
|

1. EASTERN CANADA
|

Application (950179200) by TMN NETWORKS INC. (TMN) to amend the broadcasting licence to carry on the English-language (Pay Television) programming undertaking for distribution of the MOVIEPIX pay television service in Eastern Canada by amending that part of its condition of licence #1 which reads as follows:
|
|
1. The licensee shall provide a regional, English-language general interest pay television programming service in Ontario, Quebec, New Brunswick, Nova Scotia, Prince Edward Island and Newfoundland.

TMN is seeking to amend the above condition of licence by extending its service area to include Iqaluit, Northwest Territories. The amended condition of licence would read as follows:

1. The licensee shall provide a regional, English-language general interest pay television programming service in Ontario, Quebec, New Brunswick, Nova Scotia, Prince Edward Island and Newfoundland. The licensee may also provide its programming service to Iqaluit, Northwest Territories. The authorization for the provision of service to Iqaluit will cease when and if the satellite transponder configuration or the technology is adjusted to facilitate adequate signal reception of the MovieMax service provided by Allarcom Pay Television Limited.

As part of the rationale for the proposed amendment, TMN submits that Iqaluit is in the service area licensed to Allarcom Pay Television Ltd.'s (APT) programming service known as MovieMax. However, Iqaluit is outside of the satellite footprint area able to receive an adequate signal from the APT MovieMax programming Service. MOVIEPIX, the TMN pay television service does provide an adequate signal to Iqaluit where the local cable operator has requested the MOVIEPIX service.

TMN has undertaken to cease offering its MOVIEPIX service to Iqaluit when and if Allarcom's MovieMax service becomes available in Iqaluit. Further, the Commission notes that APT has advised the cable television licensee serving Iqaluit that it agrees that the MOVIEPIX programming service may be made available to Iqaluit cable subscribers until the MovieMax satellite transponder configuration or the technology is adjusted to facilitate adequate signal reception in that location.
