AMENDMENTS TO CABLE TELEVISION
|
|
COMMUNITY CHANNEL STANDARDS
|
|
In Public Notice CRTC 1994-76 dated 29 June 1994, the Commission announced amendments to the Cable Television Regulations, 1986 (the regulations) regarding the distribution of programming on community channels.
|
|
The Commission requested the Canadian Cable Television Association (CCTA), on behalf of its members, to develop logging standards for commercial messages for Class 1 systems and Class 2 systems with 2,000 or more subscribers for incorporation into the Cable Television Community Channel Standards (the Standards). The Standards are administered by the Cable Television Standards Council.

The overall objective of the amendments is to establish standardised logging procedures and to allow the Commission to monitor the time allocated to sponsorship activity.
|
|
The amendments proposed by the CCTA are summarised as follows:
|
|
a) In Section II (Definitions) a revised definition of the types of programming.
|
|
b) Introduction of a new section pertaining to Logging Requirements. This section includes the logging requirements set out in Section 14 (1) of the regulations. The new section also calls for the community channel program logs to identify a program source description and information regarding commercial content. As well, the CCTA proposes specific logging codes for the new subsections. The full text is set out in the Appendix to this Public Notice.

After reviewing the CCTA´s proposed amendments to the Standards, the Commission considers that they adequately meet the Commission´s expectations as set out in Public Notice CRTC 1994-76. The Commission also notes that the amendments provide cable licensees with a basis for more consistent logging procedures, particularly with respect to program class descriptions.
|
|
Accordingly, the Commission hereby accepts the CCTA´s amended Community Channel Standards, as filed on 13 December 1994.

APPENDIX

AMENDMENTS TO THE CABLE TELEVISION COMMUNITY CHANNEL STANDARDS
|
|
1. Section II, Definitions
|
|
The phrase "...definition of types (sources) of programming" is changed to "...definitions of the types (classes) of programming."
|
|
2. Introduction of a new section iii) to the Community Channel Standards
|
|
iii) Logging Requirements
|
|
A cable television licensee will keep in a form consistent with the Cable Television Regulations, 1986 (the regulations), as amended periodically, a program log or a machine-readable record of programs distributed on its community channel. This log will be retained for a period of one year after the distribution of programs.
|
|
This log shall contain the following information:
|
|
(a) the date of distribution;
(b) the title; (c) the name of the undertaking at which the program was produced; (d) a brief description of the program including a statement as to whether it was produced by employees of the undertaking or by volunteers; (e) duration; (f) a program source description; and, where appropriate, (g) information regarding commercial content. |
|
The specific codes to be adopted to correspond with sections e, f, and g are set out below.
|
|
As set out in the regulations, a licensee will retain a clear and intelligible audiovisual recording of each program distributed (inclusive of sponsorship and contra messages), for a period of:
|
|
(a) four weeks from the distribution of the program; or,
|
|
(b) when the Commission receives a complaint regarding programming on the community channel or where the Commission, for any reason, wishes to investigate programming and so notifies the licensee before the expiration of the period referred to in paragraph (a), eight weeks from distribution of the program.
|
|
3.Addition to Standard ix) "Sponsorship and conventional local advertising for the benefit of community programming"
|
|
In the case of programming that contains sponsorship advertising or contra advertising, the program log will contain the tag "SA" for sponsorship advertising or "CA" for contra advertising. A licensee must also maintain the corresponding contract or letter of agreement with the advertiser or service provider for a period of one year after distribution of the programming. Within this period, the licensee must be prepared to provide these files to the Commission upon request.
