On 15 April 1998, The New Brunswick Telephone Company, Limited (NBTel) (now NBTel Inc.) filed an application for approval of tariff revisions to General Tariff Item 801.4, Contribution Charges, to recover the Carrier Access Tariff charges associated with an alternate provider of long distance service's competitive traffic which terminates in or originates from independent company territories.

1.NBTel further requested that the Commission ratify, under section 25(4) of the Telecommunications Act, the retroactive application of the proposed tariff revisions.
|
|
2.By Telecom Order CRTC 98-438, dated 7 May 1998, the Commission granted interim approval to the proposed tariff revisions and deferred consideration of the retroactive application of the revisions.
|
|
3.Comments were received from AT&T Canada Long Distance Services Company, dated 17 April 1998, and reply comments were received from Stentor Resource Centre Inc., dated 25 May 1998.
|
|
4.Based on the record of this proceeding, the Commission concludes that the retroactive application of the proposed tariff revisions is not justified in this case.
|
|
5.The Commission orders that:
|
|
a) The proposed tariff revisions are approved on a final basis.
|
|
b) The proposed retroactive application of the tariff revisions is denied.
