  CRTC approves a contribution exemption for ISP Telecom Centrex lines used for single-hop resale and administrative purposes

The CRTC approves a contribution exemption for Centrex lines used for single-hop resale and administrative purposes provided to ISP Telecom by Bell Canada.

By letter dated 15 August 2000 (received on 18 September 2000 from Bell Canada), ISP Telecom Inc. applied for a contribution exemption for Centrex services leased from Bell Canada in the Toronto area that are used solely for single-hop resale and administrative purposes. ISP Telecom provided an affidavit affirming the use of the circuits in question.

By letter dated 6 October 2000, Bell Canada submitted that the affidavit is deficient in one respect; it should affirm that no local or interexchange private line services are connected to the Centrex services to permit direct access to interexchange networks provided by ISP Telecom or any other affiliated or non-affiliated long-distance network provider.

Bell Canada confirmed that it does provide Centrex services to ISP Telecom in the Toronto exchange that appear to be eligible for a contribution exemption for single-hop resale and administrative purposes.

In light of the foregoing, Bell Canada agreed with the request for approval of an exemption. However, Bell Canada requested that such approval be conditional upon the provision by ISP Telecom of a revised affidavit addressing the deficiencies noted above.

By letter dated 11 October 2000, ISP Telecom noted that its affidavit affirms that the Centrex lines in question are not associated with any other Centrex systems. ISP Telecom submitted that its affidavit is sufficient and that a second affidavit would serve no purpose other than to restate the original affidavit.

By letter dated 26 October 2000, the Commission requested that ISP Telecom provide a revised affidavit containing Bell Canada's suggested wording.

By letter dated 1 November 2000, ISP Telecom provided a new affidavit that included the phrase in question.

The Commission is of the view that ISP Telecom has provided evidence that meets the evidentiary requirements for an exemption for single-hop and administrative circuits. Accordingly, the Commission approves ISP Telecom's application effective the date of installation for the administrative circuits, and the date of application for the single-hop circuits, pursuant to Effective date of contribution exemptions, Telecom Public Notice CRTC 95-26 dated 12 June 1995.
