Low-power ethnic FM radio station near Aylmer

1.

The Commission approves the application by the Aylmer and Area Inter-Mennonite Community Council for a low-power FM German-language radio programming undertaking near Aylmer, Ontario.

The station will provide four hours per day of programming of particular interest to members of the local German-speaking Mennonite community, a great many of whom do not speak English. It will broadcast from 7:00 a.m. to 8:00 a.m. and from 5:00 p.m. to 8:00 p.m. on a daily basis. The programming will consist of news, weather, ethnic and cultural music, health care information, and other.

The station will operate at 107.7 MHz (channel 299LP) with an effective radiated power of 50 watts.

The Commission received one intervention in support of this application.

The Commission notes that a single language station (broadcasting in neither English, French nor an Aboriginal language) is not contemplated by the Commission's Ethnic Broadcasting Policy, Public Notice CRTC 1999-117, 16 July 1999. However, the Commission has taken into consideration that the station will be providing a service targeting those who are unfamiliar with the English language and, as such, are unserved. In addressing their needs, it will offer limited airtime, and will be located in a rural area having no other local broadcaster.

The Commission also took into account that the station will help bridge the cultural gap between the English-language community and this minority language group. Also, it will enhance cultural diversity in the Canadian broadcasting system.

The licence will expire 31 August 2009 and will be subject to the conditions set out in the appendix to this decision.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Given that the technical parameters approved in this decision are for a low-power unprotected FM service, the Commission also reminds the licensee that it will have to select another frequency if the Department so requires.

Furthermore, the licence for this undertaking will be issued once the licensee has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 16 January 2005. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

Appendix to Broadcasting Decision CRTC 2003-10

 

Conditions of licence

1.

The licence will be subject to the following conditions of licence as well as the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999, with the exception of conditions of licence no. 5 and no. 9, relating to Canadian talent development and the solicitation of local advertising. Condition of licence no. 9, relating to the solicitation of local advertising, does not apply to stations operating in a single-station market.

2.

The station shall be operated within the Specialty format as defined in A review of certain matters concerning radio, Public Notice CRTC 1995-60, 21 April 1995, and Revised content categories and subcategories for radio, Public Notice CRTC 2000-14, 28 January 2000, as amended from time to time.

3.

The licensee must use the station solely for the purpose of providing programming in the German language.

4.

The licensee shall not broadcast more than six minutes of advertising material during each clock hour.

5.

The licensee shall ensure that at least 90% of the music will be drawn from Category 3 (special interest music).
