In this decision, the Commission approves revised rates for Category I Competitor Services for Bell Canada, Aliant Telecom Inc., MTS Communications Inc., Saskatchewan Telecommunications and TELUS Communications Inc., pursuant to the directives set out in Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002.

Introduction

1.

In Implementation of price cap regulation and related issues, Telecom Decision CRTC 98-2, 5 March 1998, the Commission concluded that it was appropriate to assign an incumbent local exchange carrier (ILEC) service to the Competitor Services category if the service was in the nature of an essential service or was primarily used by telecommunications service providers.

In Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002, (Decision 2002-34), the Commission decided to establish two categories within the Competitor Services basket in order to clarify the pricing treatment of these services. The first category within the Competitor Services basket, Category I Competitor Services, was comprised of those services which were in the nature of an essential service. Services in the nature of an essential service were the interconnection and ancillary services that were required by Canadian carriers and resellers interconnecting to the ILEC's networks, including essential services as defined in Local Competition, Telecom Decision CRTC 97-8, 1 May 1997 as well as near-essential services, such as those that were the subject of Local competition Sunset clause for near-essential facilities, Order CRTC 2001-184, 1 March 2001.

The second category within the Competitor Services basket, Category II Competitor Services, included those services developed for use by telecommunications service providers, other than services in the nature of an essential service.

The preliminary assignment of Competitor Services to either Category I or Category II was set out by the Commission in Appendix I to Decision 2002-34. The Commission also initiated a proceeding, in Decision 2002-34, to allow parties to the proceeding to comment on the preliminary service assignments. The Commission's decision in that respect has been issued today in Follow-up to Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34 - Service basket assignment, Decision 2003-11(Decision 2003-11).

In Decision 2002-34, the Commission reduced the mark-up on Phase II costs included in the rates for most Category I Competitor Services from 25% to 15%. The Commission found that a 15% mark-up on these services' Phase II costs, that were subject to mandated cost-based pricing, would provide sufficient contribution towards the recovery of that ILEC's fixed common expenses and the embedded cost differential. The Commission, in Decision 2002-34, also adopted a rate element constraint equal to inflation (I) less the productivity offset (X) for all Category I Competitor Services, with the exception of those Category I Competitor Services whose rates explicitly reflect productivity gains. The Commission, in Decision 2002-34, also found that all usage rates of less than $1.00 were to be rounded to the fourth decimal place, with the exception of the Direct Connect (DC) and Access Tandem (AT) service rates which were to be rounded to the fifth decimal place.

In Decision 2002-34, the Commission made all tariff rates for each ILEC interim, effective 1 June 2002, with the expectation that any rate changes to the Category I Competitive Service rates would become effective retroactive to that date. Each ILEC was directed to file for approval proposed tariff pages reflecting the Commission's determinations for the Category I Competitor Service rates, as specified in Appendix 1 of that decision.

Bell Canada, Aliant Telecom Inc. (Aliant Telecom), MTS Communications Inc. (MTS), Saskatchewan Telecommunications (SaskTel), former TELUS Communications Inc. operating in Alberta, TELUS Communications (B.C.) Inc. (TCBC) (and amalgamated to form TELUS Communications Inc. (TCI)) filed tariff notices on 6 August 2002 in respect of the revised Category I Competitor Service rates. Amended tariff notices were subsequently received from Bell Canada, Aliant Telecom, former TCI and TCBC.

No comments were provided regarding the proposed rates other than the comments provided in the context of the proceeding leading to Decision 2003-11.

Category I Competitor Services that are not considered in this decision

The Commission notes that since the issuance of Decision 2002-34, rates for the AT and DC services were approved on an interim basis in Interim rates for Access Tandem service and Direct Connection Service, Telecom Order CRTC 2002-384, 24 September 2002. Subsequently, the Commission approved revised interim AT rates for Aliant Telecom, Bell Canada, MTS and SaskTel in Revised rates for Access Tandem service, Telecom Order CRTC 2002-412, 31 October 2002. These rates supersede the rates proposed in the applications from the ILECs that are the subject of this decision. Accordingly, the rates for the DC and AT services, which will continue to be interim, are not considered in this decision and are excluded from Attachment 1.

In Rates for co-location floor space, Direct Connection service, Wireless Access Service: Line-side Access services, and Wireless Service Providers Enhanced Provincial 9-1-1 Network Access service, Telecom Decision CRTC 2003-12, 18 March 2003 (Decision 2003-12), the Commission approved rates for co-location floor space, Wireless Service Provider (WSP) Enhanced Provincial 9-1-1 Network Access service and Bell Canada's line side wireless access service (WAS). Bell Canada's telephone number rates are applicable to both WAS: Line-side Access and Paging/telephone number access (TNA) services. The revised rates for these services are set out in Decision 2003-12. Accordingly, the revised rates for co-location floor space, Bell Canada's WAS: Line-side telephone number and Paging/TNA services, and WSP Enhanced Provincial 9-1-1 Network Access service are not considered in this decision and are excluded from Attachment 1. Furthermore, the Commission is initiating a proceeding in Decision 2003-12 to review the rates for WAS: Line-side Access telephone number and access channel service rates and paging/TNA services for Aliant Telecom, MTS, SaskTel and TCI. Accordingly, the rates for these services for these ILECs will continue to be interim.

Changes to the ILEC proposed service classifications

The Commission, in Decision 2003-11, revised several of the ILECs' proposed Competitor Service classifications.

12.

The Commission revised Aliant Telecom's proposed Competitor Service classifications in Decision 2003-11 for the following services: Mobile Radio Network Access Service 7-Digit Telephone Number, 800 Carrier Access Multi-Carrier Selection Capability, Unbundled Loop Service Charge per Order, Unbundled Loop Service Charge per Loop, WAS Repair Visit and Local Number Portability Access to Service Control Point.

13.

Aliant Telecom proposed rates for WAS Repair Visit that did not reflect the application of the mark-up reduction. The Commission, in Decision 2003-11, determined that the rates for WAS Repair Visit should include the application of the mark-up reduction.

14.

Aliant Telecom proposed rates for Unbundled Loop Service Charge per Loop, Unbundled Loop Service Charge per Order and 800 Carrier Access Multi-Carrier Selection Capability that did not reflect the application of the I-X constraint. The Commission, in Decision 2003-11 determined that the rates for the Unbundled Loop Service Charge per Loop, Unbundled Loop Service Charge per Order and 800 Carrier Access Multi-Carrier Selection Capability should reflect the application of the I-X constraint.

15.

Aliant Telecom proposed a rate for Mobile Radio Network Access Service: 7-Digit Telephone Numbers that did not reflect the application of the mark-up reduction and the I-X constraint. The Commission, in Decision 2003-11 determined that the rate for Mobile Radio Network Access Service 7-Digit Telephone Number should reflect the application of the mark-up reduction and the I-X constraint.

Aliant Telecom proposed rates for Local Number Portability Access to Service Control Point that included the application of the mark-up reduction and the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for Local Number Portability Access to Service Control Point should not reflect the application of the mark-up reduction and the I-X constraint.

17.

The Commission revised Bell Canada's proposed Competitor Service classifications in Decision 2003-11 for the following services: 800 Carrier Access Multi-Carrier Selection Capability, Unbundled Loop Service Charge per Order, Unbundled Loop Service Charge per Loop, Local Number Portability Access to Service Control Point, Remote Switching and digital subscriber line access multiplexer (DSLAM) Information, asymmetric digital subscriber line (ADSL) Coverage Information, Application Charge per Request per Central Office, Zero-Dialed Emergency Call Routing service, and Relay Service: Set-up Charge.

18.

Bell Canada proposed rates for Unbundled Loop Service Charge per Loop and Unbundled Loop Service Charge per Order that did not reflect the application of the mark-up reduction. The Commission, in Decision 2003-11 determined that the rates for Unbundled Loop Service Charge per Loop, and Unbundled Loop Service Charge per Order should reflect the application of the mark-up reduction.

19.

Bell Canada proposed rates for 800 Carrier Access Multi-Carrier Selection Capability that did not reflect the application of the I-X constraint. The Commission, in Decision 2003-11 determined that the rates for 800 Carrier Access Multi-Carrier Selection Capability should reflect the application of the I-X constraint.

20.

Bell Canada proposed rates for Remote Switching and DSLAM Information, ADSL Coverage Information, Zero-Dialed Emergency Call Routing service, and Relay Service: Set-up Charge that did not reflect the application of the mark-up reduction and the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for Remote Switching and DSLAM Information ADSL Coverage Information, Zero-Dialed Emergency Call Routing, and Relay Service: Set-up Charge should reflect the application of the mark-up reduction and the I-X constraint.

21.

Bell Canada proposed rates for Local Number Portability Access to Service Control Point that reflected the application of the mark-up reduction and the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for this service should not reflect the application of the mark-up reduction and the I-X constraint.

The Commission revised MTS' proposed Competitor Service classifications in Decision 2003-11 for the following services: Unbundled Loop Service Charge per Order, Unbundled Loop Service Charge per Loop,800 Carrier Access Multi-Carrier Selection Capability, Network announcements for customers of Disconnected interexchange carriers (IXCs) with Feature Group D service, and Local Number Portability Access to Service Control Point.

23.

MTS proposed rates for the Unbundled Loop Service Charge per Loop, Unbundled Loop Service Charge per Order, 800 Carrier Access Multi-Carrier Selection Capability, and Network announcements for customers of Disconnected IXCs with Feature Group D service that did not reflect the application of the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for the Unbundled Loop Service Charge per Loop, Unbundled Loop Service Charge per Order , 800 Carrier Access Multi-Carrier Selection Capability, and Network announcements for customers of Disconnected IXCs with Feature Group D service should reflect the application of the I-X constraint.

MTS proposed rates for Local Number Portability Access to Service Control Point that reflected the application of the mark-up reduction and the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for Local Number Portability Access to Service Control Point should not reflect the application of the mark-up reduction and the I-X constraint.

25.

The Commission revised SaskTel's proposed Competitor Service classifications in Decision 2003-11 for the following services: Floor space Physical Co-Location Arrangement and Floor space Virtual Co-Location Arrangement, WSP Network Access Service Trouble Investigation, Zero-Dialed Emergency Call Routing service, Other loop related charges: Loop selection, and Payphone Compensation per Call.

26.

SaskTel proposed rates for Floor space Physical Co-Location Arrangement and Floor space Virtual Co-Location Arrangement that did not reflect the application of the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for Floor space Physical Co-Location Arrangement, and Floor space Virtual Co-Location Arrangement should reflect the application of the I-X constraint.

27.

SaskTel proposed rates for WSP Network Access Service: Trouble Investigation and Other loop related charges: Loop selection, that did not reflect the application of the mark-up reduction. The Commission, in Decision 2003-11, determined that the rates for WSP Network Access Service Trouble Investigation, and Other loop related charges: Loop selection should reflect the application of the mark-up reduction.

28.

SaskTel proposed rates for Zero-Dialed Emergency Call Routing service, and Payphone Compensation per Call that did not reflect the application of the mark-up reduction and the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for Zero-Dialed Emergency Call Routing service and Payphone Compensation per Call should reflect the application of the mark-up reduction and the I-X constraint.

The Commission revised TCI's proposed Competitor Service classifications in Decision 2003-11 for the following services: Unbundled Loop Service Charge per Order, Unbundled Loop Service Charge per Loop, Unbundled Loop Selection service, Payphone per Call Compensation, 9-1-1 Maps and 800 Carrier Access Multi-Carrier Selection Capability.

30.

TCI proposed rates for 9-1-1 Maps that did not reflect the application of the mark-up reduction. The Commission, in Decision 2003-11, determined that the rates for 9-1-1 Maps should reflect the application of the mark-up reduction.

31.

TCI proposed rates for Unbundled Loop Service Charge per Order, Unbundled Loop Service Charge per Loop, Unbundled Loop Selection service, and 800 Carrier Access Multi-Carrier Selection Capability that did not reflect the application of the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for the Unbundled Loop Service Charge per Order, Unbundled Loop Service Charge per Loop, Unbundled Loop Selection service, and 800 Carrier Access Multi-Carrier Selection Capability should reflect the application of the I-X constraint.

32.

TCI proposed rates for Payphone per Call Compensation that did not reflect the application of the mark-up reduction and the I-X constraint. The Commission, in Decision 2003-11, determined that the rates for Payphone per Call Compensation should reflect the application of the mark-up reduction and the I-X constraint.

33.

Attachment 1 sets out the rates for the above noted services.

Changes to the ILEC-proposed Category I Competitor Service rates

34.

In reviewing the ILECs' rate proposals for Category I Competitor Services, the Commission found that the proposed rates for certain Competitor Services did not comply with the directives set out in Decision 2002-34.

35.

For Aliant Telecom, the proposed rates for Bulk Transfer of Customer Base between IXCs having Feature Group D service, WAS Line-Side Access: Telephone number service charges, Voice information Access service, and Local Network Interconnection and Ancillary Services: Riser Space did not reflect the application of the mark-up reduction and the I-X constraint as required by Decision 2002-34.

36.

For Bell Canada, the proposed rates for Local Network Interconnection and Ancillary Services: Riser Space did not reflect the application of the mark-up reduction and the I-X constraint as required by Decision 2002-34 directives.

37.

For Bell Canada, the proposed rate for Network Portability Access Service per Telephone number placed in service was rounded to two decimal places. The Commission notes that the rate for this service is less than $1.00. The Commission also notes that the rate is applied to the number of telephone numbers placed in service used by a service provider. The Commission therefore considers that this rate is usage based and should be rounded to four decimal places.

38.

Bell Canada also proposed a rate for the Basic Listing Interchange File service that was rounded to three decimal places. The Commission notes that the rate for this service is less than $1.00. The Commission also notes that the rate is applied to the number of basic listings used by a service provider. The Commission therefore considers that this rate is usage based and should be rounded to four decimal places.

39.

Bell Canada proposed revised rates for Message Monitor, Toll Saver, and Switched Network Access for Radio System Operators: Networks, 1 Access Channel services. Bell Canada submitted that the rates for these services were not usage rates and were being rounded to two decimal places. The Commission notes that the rates for these services are less than $1.00. The Commission also notes that these rates are applied to the number of units used by a service provider. The Commission therefore considers that these rates are usage based and should be rounded to four decimal places.

40.

For MTS, the proposed rates for Co-location: Riser Space and PIC Processing services were rounded to two decimal places. The Commission notes that these rates are less than $1.00 and are usage rates. The Commission therefore considers, consistent with the directives set out in Decision 2002-34, that these rates should be rounded to four decimal places.

41.

For MTS, the proposed rate for Compensation per Call was rounded to two decimal places. The Commission notes that this rate is less than $1.00 and is a usage rate. The Commission therefore considers, consistent with the directives set out in Decision 2002-34, that this rate should be rounded to four decimal places.

42.

For MTS, the proposed rates for Local Network Interconnection and Ancillary Services: Riser Space and Relay Set-up Charge per competitive local exchange carrier (CLEC) did not reflect the application of the mark-up reduction and the application of the I-X constraint as required by Decision 2002-34.

43.

For MTS, the proposed rate for Co-location: Floor Space was revised to correct a rounding error.

44.

For SaskTel, the proposed rates for Message Manager service did not reflect the application of the I-X constraint as required by Decision 2002-34.

45.

For SaskTel, the proposed rates for Co-location: Power Delivery, Project Management Fee, Site Preparation Fee, Installation/Maintenance, Cable Pulling/Splicing, Unbundled Local Loop Type A - Rate Band E, and Other Loop Related Charges: Diagnostic Maintenance Charge did not reflect the application of the mark-up reduction as required by Decision 2002-34.

46.

For SaskTel, the proposed rate for Local Network Interconnection and Ancillary Services: Riser Space, Unbundled Loop Connecting Link Service excluding Connecting Link C, Co-location Application Charge and Message Relay Service: Set-Up charge did not reflect the application of the mark-up reduction and the I-X constraint as required by Decision 2002-34.

47.

For TCI, the proposed rates for Radio Paging System Access Services, Relay Set-up Charge per CLEC, Network Portability Access services, Co-location Arrangements for Interconnecting Canadian Carriers: Application Charge, Virtual Co-Location: Access to Synchronization Clock Category 1 Toll Centre, Virtual Co-Location: Access to Synchronization Clock Category 2 Host/Remote, Virtual Co-Location: Transition Cabinet, Physical Co-Location: Access to Synchronization Clock Category 1 Toll Centre, Physical Co-Location: Access to Synchronization Clock Category 2 Host/Remote, Physical Co-Location: Transition Cabinet, Power Consumption services, Building Riser Space and Fibre Optic Cable, Construction Fee, Local Network Interconnection and Ancillary Services: Riser Space, and Entrance Conduit Space did not reflect the application of the mark-up reduction and the I-X constraint as required by Decision 2002-34 directives.

48.

TCI proposed revised rates for Paging Party Originator Billing Usage Rate, SAT-1 Wireless Service: Telephone Number services, Switched Access Types for Conventional Public Mobile Radio Systems: Telephone Number services and Call Forwarding - Wholesale - B.C. only service that were rounded to two decimal places, all of which are offered in British Columbia. TCI indicated that it had billing system constraints and could not adopt rates rounded to four decimal places. TCI proposed to truncate the rates for these services to two decimal places. TCI also stated it would keep track of the rates rounded to four decimal places and use them to apply reductions for the subsequent years. The Commission, given the circumstances, considers TCI's rate proposal for these services to be appropriate. The Commission further directs TCI to keep track of the rates rounded to four decimal places in order to determine the appropriate rates in subsequent years. In each subsequent year, the rate for each of these services is to be determined by applying the annual I-X constraint to the previous year's four-digit rate. The four-digit rate is then to be truncated to two decimal places for the tariff.

Attachment 1 sets out the rates for the above noted services.

The Commission approves on an interim basis the rates for the following Category I Competitor Services that are considered in this proceeding as they are being examined in separate proceedings:

a) Co-location Power service,
b) ADSL Loop Administration and Support service,
c) PIC Processing services, and
d) 800/888 Carrier Access Multi-Carrier Selection Capability: Development Charge per query.

51.

The Commission approves on a final basis the rates for the remainder of the Category I Competitor Services that are considered in this decision and the Category II services except for the Equal Access Start-up charge, ADSL Access service, and ADSL High-speed Service Provider Interface service. The Commission notes that the rates for the Equal Access Start-up charge, ADSL Access service, and ADSL High-speed Service Provider Interface service, are being examined in separate proceedings and remain interim.

52.

The approved rates take effect on 1 June 2002.

53.

The Commission directs the ILECs to issue revised tariff pages forthwith reflecting the above changes, with an effective date of 1 June 2002.

54.

The Commission directs the ILECs to provide all customers affected by rate reductions approved in this decision with rebates forthwith.
