Destandardization of Type C Local Loop service

The Commission received an application by Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), dated 4 April 2007, proposing revisions to the former Aliant Telecom Inc.'s General Tariff item 646 - Local Network Interconnection and Component Unbundling, to destandardize Type C Local Loop service as it was a redundant service. In support of its application, Bell Aliant provided the information required by the Commission in Telecom Circular 2005-7, which established new procedures for the destandardization and/or withdrawal of tariffed services, including a copy of the notice sent to affected customers.

Bell Aliant submitted that it would continue to provide the functionality associated with Type C Local Loops through Competitor Digital Network (CDN) Service and Digital Network Access (DNA) Service.

The Commission received no comments on this application.

The Commission notes that, under Bell Aliant's proposal, new installations, moves, rearrangements, or other changes at the same or different premises will no longer be allowed, but that existing customers will continue to receive the service. The Commission also notes that customers wishing to expand their Type C Local Loop service can do so by using CDN or DNA services at DS-1 speed, as applicable. The Commission considers that CDN and DNA services at DS-1 speed are acceptable substitutes for Type C Local Loop service in terms of functionality, cost, and geographical location.

The Commission notes that similar applications by TELUS Communications Company (former TELUS Communications Inc. Tariff Notice 582 and former TELUS Communications (B.C.) Inc. Tariff Notice 4269) and MTS Allstream Inc. (Tariff Notice 612) to destandardize Type C Local Loops were approved in Telecom Orders 2007-156 and 2007-167, respectively. In these Orders the Commission considered that CDN and DNA services at DS-1 speed were acceptable as substitute services to Type C Local Loop service.

The Commission finds that Bell Aliant has fulfilled the customer notification and evidentiary requirements set out in Telecom Circular 2005-7. Further, the Commission considers that the impact of the destandardization of Type C Local Loop service on existing customers would be minimal. Therefore, the Commission considers that Bell Aliant's proposal to destandardize this service is reasonable.

In light of the above, the Commission approves Bell Aliant's application.
