Re:CRTC Public Hearing commencing on 12 May 2010 in Toronto. CKLN-FM Radio Inc. (the licensee) is in apparent non-compliance with the Radio Regulations, 1986

 

Dear Sir/Madam

The matters referred to in the Broadcasting Notice of Consultation CRTC 2010-146 ("Notice") have been placed on the agenda of the Public Hearing to commence on 12 May 2010 in Toronto, Ontario at 9:30 a.m. at the Four Points Sheraton Toronto Airport West, 6090 Dixie Road, Mississauga, Ontario.  A copy of the Notice is enclosed.

Please be advised that, as stated in the attached Notice, the Commission requires the

appearance of CKLN-FM Radio Inc. at the above-noted Public Hearing.

In accordance with the Broadcasting Act, this Notice will be published in the Canada Gazette and in newspapers circulated in your area.

The material that forms part of the record of this public hearing includes the letter of the Secretary General dated 10 February 2010 (the Secretary General letter), the licensee’s file that was attached to this letter, and the response to the Secretary General’s letter filed by representatives of the licensee on 1 March 2010.  

This record includes certain information designated as confidential which is not included in the licensee’s public file. In particular, certain personal information of third parties found in the report filed by representatives of the licensee on 6 October, 2009 for which confidentiality was not requested has nonetheless been deemed confidential and has been abridged from the licensee’s public file. For ease of reference, a copy of licensee’s public file, with all confidential information abridged, has been enclosed with the hardcopy of this letter.

As noted in the enclosed Notice, additional documents may be added to the file at a subsequent time and the licensee is advised to consult the public file for this item on an ongoing basis. In particular, the Commission intends to conduct an evaluation of the logger tapes filed by representatives of the licensee on 1 March 2010. Any resulting report, which may include additional allegations of apparent non-compliance, will be added to the public file for this item before the close of the comment period set out in the notice.

In their reply to the Secretary General letter, representatives of the licensee indicated that they intended to file with the Commission responses to certain complaints, the licensee’s 2009 Annual Return, and the program logs requested in the Secretary General letter in the near future. If the licensee wishes to add documents to the public record of this proceeding, it should send a request to do so with rationale for why the document should be accepted, attaching the document, at the earliest possible opportunity and no later than 29 March, 2010.

A copy of the public record for this Hearing will be available at the CRTC offices in Toronto and Gatineau. The licensee is not required to make its copy of the public record available for review by interested persons at its premises. If the licensee chooses to make the public record available for review at its premises, it must ensure that the information identified as confidential is not disclosed. If the licensee chooses not to make the public record available for review at its premises, it should respond to any inquiries from interested persons by referring these persons to the nearest CRTC office. A list of CRTC offices can be found at the end of the enclosed Notice.

The licensee is expected to broadcast notice of this public hearing over its facilities. This notice should state the day fixed for the commencement of the public hearing; the nature of the matters to be heard at the public hearing; and the rights of all persons in respect of the public hearing, including the time for filing an intervention. This notice should be broadcast at least four times between 13 March, 2010 and 1 April, 2010 between 0700 hours and 0900 hours or between 1600 hours and 1800 hours, local time.

Interested  parties who wish to file submissions with respect to this matter may do so by completing the electronic submission form available in the Commission's Notice.  The use of this electronic form will greatly facilitate the process of submissions by the Commission.

Please note that the licensee may file with the Commission a reply to any submissions filed by interested persons no later than 22 April, 2010.  A copy of the reply must be served on the party who filed the submission.  The Commission will not systematically solicit replies to submissions.
