Various commercial radio stations – Licence renewals

  1. The Commission has the authority, pursuant to section 9(1) of the Broadcasting Act (the Act), to issue and renew licences for such terms not exceeding seven years and subject to such conditions related to the circumstances of the licensee as it deems appropriate for the implementation of the broadcasting policy set out in section 3(1) of the Act.
  2. Consistent with that authority, the Commission renews the broadcasting licences for the English-language commercial radio programming undertakings listed below from 1 September 2020 to 31 August 2027. The terms and conditions of licence for these stations are set out in the appendix to this decision.

  1. The licensee must fulfill all the remaining tangible benefits resulting from the change in the ownership and effective control approved in Broadcasting Decision 2018-404, as well as tangible benefits listed in that decision.

Tangible benefits – CKSJ-FM St. John’s and its transmitter CKSJ-FM-1 Bluff Point

  1. The licensee must fulfill all the remaining tangible benefits resulting from the change in the ownership and effective control approved in Administrative Commission letter L2016-0076 dated 15 July 2016.

Local programming – CKZZ-FM Vancouver, CHIQ-FM Winnipeg, CHBM-FM Toronto, CING-FM Hamilton, CIRR-FM Toronto, CJGB-FM Meaford and CKSJ-FM St. John’s and its transmitter CKSJ-FM-1 Bluff Point

  1. Local radio stations are an important daily source of local news and information for communities. Holding a broadcasting licence comes with conditions, regulatory obligations and responsibilities, which include contributing to the Canadian broadcasting system by ensuring that Canadians have access to local programming that reflects their needs and interests and informs them of important current issues.
  2. The licensees proposed for the following stations to broadcast the following weekly levels of news:
    • CKZZ-FM Vancouver – 1 hour 15 minutes;
    • CHIQ-FM Winnipeg – 0 hour;
    • CHBM-FM Toronto – 52 minutes;
    • CING-FM Hamilton – 6 minutes;
    • CIRR-FM Toronto – 1 hour
    • CJGB-FM Meaford – 1 hour 45 minutes; and
    • CKSJ-FM St. John’s and its transmitter CKSJ-FM-1 Bluff Point – 1 hour 42 minutes.
  3. Although Broadcasting Public Notice 2006-158 does not specify a minimum level of weekly news to be broadcast, it does specify the type of spoken word material that must be included as part of a station’s local programming. In accordance with that public notice, the Commission reminds the licensees that the above-noted stations, in their local programming, must incorporate spoken word material of direct and particular relevance to the communities served, and that this programming must include local news, weather, sports coverage, and the promotion of local events and activities. In addition, the Commission encourages the licensees to ensure that a reasonable amount of daily local news and information is made available to those communities.

Subsidiary Communications Multiplex Operation – CING-FM Hamilton

  1. The Commission reminds the licensee that as stated in section 3(1)(h) of the Broadcasting Act, it is responsible for the programs that it broadcasts. The licensee is therefore expected to ensure that its Subsidiary Communications Multiplex Operation (SCMO) service is operated in a responsible manner and to adhere to the guidelines regarding the provision of SCMO services set out in Appendix A to Public Notice 1989-23.

Open-line programming – CIRR-FM Toronto

  1. The Commission reminds the licensee that it expects licensees who broadcast open-line programming to adhere to the policy regarding such programming, as set out in Public Notice 1988-213.

Force and effect of broadcasting certificates

  1. Pursuant to section 22 of the Act, the broadcasting licences renewed in this decision will cease to have any force or effect if the broadcasting certificates issued by the Department of Industry lapse.

Employment equity

  1. Because 8384878 Canada Inc., 8504580 Canada Inc., Corus Radio Inc., Dufferin Communications Inc., Walsh Investment Inc., My Broadcasting Corporation and Yorkton Broadcasting Company Limited, partners in a general partnership carrying on business as GX Radio Partnership and Jim Pattison Broadcast Group Ltd. (the general partner) and Jim Pattison Industries Ltd. (the limited partner), carrying on business as Jim Pattison Broadcast Group Limited Partnership are subject to the Employment Equity Act and file reports concerning employment equity with the Department of Employment and Social Development, their employment equity practices are not examined by the Commission.

Appendix to Broadcasting Decision CRTC 2020-265

Terms, conditions of licence, expectation and encouragements for the English-language commercial radio programming undertakings for which the broadcasting licences have been renewed in this decision

Terms

The licence will expire 31 August 2027.

Conditions of licence applicable to all stations

  1. The licensee shall adhere to the conditions of licence set out in Conditions of licence for commercial AM and FM radio stations, Broadcasting Regulatory Policy CRTC 2009-62, 11 February 2009, as well as to the conditions set out in the broadcasting licence for the undertaking.

Additional conditions of licence applicable to CING-FM Hamilton

  1. The licensee has the authority to make use of a Subsidiary Communications Multiplex Operation (SCMO) channel for the purpose of distributing primarily Tamil-language programming.
  2. The licensee shall provide commercially reasonable access to advertising availabilities to unrelated operators of broadcasting undertakings and telecommunications service providers.

Additional condition of licence applicable to CIRR-FM Toronto

  1. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations), in any broadcast week:
    • devote, in that broadcast week, a minimum of 40% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety; and
    • devote, between 6:00 a.m. and 6:00 p.m., in the period from Monday to Friday of the same broadcast week, a minimum of 40% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.


    For the purposes of this condition, the terms “broadcast week,” “Canadian selection,” “content category” and “musical selection” shall have the same meanings as those set out in the Regulations.

Additional condition of licence applicable to CJGB-FM Meaford

  1. In addition to the basic annual contribution to Canadian content development (CCD), set out in section 15 of the Radio Regulations, 1986, the licensee shall, by no later than 31 August 2021 make a $4,500 contribution to the promotion and development of Canadian content.


    Of this amount, the licensee shall allocate at least 20% to FACTOR or MUSICACTION. The remainder of this additional CCD contribution shall be allocated to parties and initiatives fulfilling the definition of eligible initiatives set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006.

Additional conditions of licence applicable to CKMO-FM Orangeville

  1. The licensee shall, as an exception to the percentage of Canadian musical selections set out in sections 2.2(8) and 2.2(9) of the Radio Regulations, 1986 (the Regulations), in any broadcast week:
    • Devote, in that broadcast week, a minimum of 38% of its musical selections from content category 2 (Popular Music) to Canadian selections broadcast in their entirety; and
    • Devote, between 6:00 a.m. and 6:00 p.m., in the period from Monday to Friday of the same broadcast week, a minimum of 38% of its musical selections from content category 2 to Canadian selections broadcast in their entirety.


    For the purposes of this condition, the terms “broadcast week,” “Canadian selection,” “content category” and “musical selection” shall have the same meaning as that set out in the Regulations.

  2. In order to fulfill its outstanding commitments to Canadian content development (CCD) set out in English-language FM radio station in Orangeville, Broadcasting Decision CRTC 2014-378, 18 July 2014, the licensee shall, in addition to the basic annual contribution to CCD, set out in section 15 of the Radio Regulations, 1986 make, by no later than 31 August 2021, a $500 contribution to the promotion and development of Canadian content.


    Of this amount, not less than 20% per broadcast year shall be devoted to FACTOR or MUSICACTION. The remainder shall be allocated to parties and initiatives fulfilling the definition of eligible initiatives set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006.

  3. The licensee shall identify the radio station as an Orangeville, Ontario radio station, through the broadcast of announcements to that effect throughout the broadcast day, and shall refrain from broadcasting station identification announcements that contain exclusive references to the City of Toronto.
  4. In each traffic report and weather report broadcast by the station, the licensee shall include references to Orangeville and Dufferin County, Ontario.

Additional conditions of licence applicable to CJTN-FM Quinte West

  1. The licensee shall not broadcast separate commercial messages on its Quinte West station during periods when the same programs are broadcast simultaneously on the licensee’s Belleville and Quinte West stations.
  2. The licensee shall, in addition to its basic contributions to Canadian content development (CCD) as required by section 15 of the Radio Regulations, 1986, devote a minimum of $11,300 per broadcast year towards parties and initiatives fulfilling the definition of eligible CCD initiatives set out in paragraph 108 of Commercial Radio Policy 2006, Broadcasting Public Notice CRTC 2006-158, 15 December 2006.

Expectation applicable to all stations

The Commission expects the licensees to reflect the cultural diversity of Canada in its programming and employment practices.

Encouragement applicable to CKSJ-FM St. John’s and its transmitter CKSJ‑FM Bluff Point and CJTN-FM Quinte West

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensees to consider employment equity issues in their hiring practices and in all other aspects of their management of human resources.
