Saskatchewan Telecommunications – Tariff Notice 382 – Final approval of a tariff application

Application

  1. On 16 May 2024, the Commission received an application from Saskatchewan Telecommunications (SaskTel), Tariff Notice (TN) 382. The company proposed a change to item 160.10 of its General Tariff, Telephone Directory Service.
  2. SaskTel previously submitted TN 380 on 4 March 2024 to change the rates for various tariff items in accordance with price cap constraints. These rate changes came into effect on 31 March 2024. In TN 382, SaskTel submitted that TN 380 mistakenly included changes to rates for non-listed and non-published numbers, which, pursuant to Telecom Decision 2002-34, were categorized as services with frozen rate treatment.
  3. SaskTel proposed to reverse the changes made to tariff item 160.10 effective 31 March 2024. SaskTel submitted that this would result in all impacted customers receiving a credit for the amount by which they were overcharged.
  4. SaskTel submitted that because there were no price increases included in TN 382, and the rates in question should be frozen, there is no requirement to complete a price floor test.
  5. InTelecom Order 2024-152, the Commission approved SaskTel’s application on an interim basis, with an effective date of 8 July 2024. The Commission stated that it would address the ratification request in a subsequent order.

Commission’s analysis

  1. Pursuant to subsection 25(4) of the Telecommunications Act, the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.
  2. The Commission considers that SaskTel incorrectly applied changes to item 160.10 of its General Tariff. Given that these rate elements were to be frozen, the Commission considers that it would be appropriate to ratify the rates proposed in TN 382 for the period of 31 March 2024 to the date of the interim approval of SaskTel’s application, and to require SaskTel to refund the amounts that were overcharged to customers.

Conclusion

  1. The Commission approves SaskTel’s application on a final basis and, in light of the above, ratifies the proposed rates for the above-noted service for the period of 31 March 2024 to 8 July 2024, the date of interim approval of this application.
  2. The Commission directs SaskTel to refund the difference to customers for the period that they were overcharged.
