Dear Monica Auer,

Thank you for your letter dated 3 December 2024 filed on behalf of the Forum for Research and Policy in Communications (FRPC) regarding Broadcasting Notice of Consultation 2024-288 - The Path Forward - Defining “Canadian program” and supporting the creation and distribution of Canadian programming in the audiovisual sector (NoC 2024-288).

FRPC requested clarification as to whether “pages”, where the notice of consultation sets the maximum number of pages for intervention, referred to “physical page” or to “pagination”, as well as clarifications on several elements of NoC 2024-288.

As regards the clarifications requested on the definition of “pages” permissible for the interventions, there is no such definition in the CRTC’s Rules of Practice and Procedure (the Rules). In staff’s view, it would however be appropriate to interpret “pagination” as physical copy, single-sided page as this would be consistent with both past practice and the Federal Courts Rules, Rule 65 in particular.

With respect to clarifications sought on specific wording used in NoC 2024-288, we have reviewed carefully each of the instances discussed in the letter. The information provided in NoC 2024-288 is sufficiently clear to indicate the topics at issue in the proceeding and to enable participants to provide their views on matters of interest to them. Parties may explain their interpretation of and views on the topics at issue as a part of their submissions made at the various stages of the proceeding. Accordingly, further clarifications are not required.
