Cost recovery charges (Online News Act)
- The Online News Act (the Act) applies to the operators of the largest online platforms that make news content available in Canada. Under the Act, the Commission can make regulations that allow it to recover the costs of its regulatory work from these operators.
- The Cost Recovery (Online News Act) RegulationsFootnote 1 (the Regulations) came into force on 1 April 2025. As explained in Cost Recovery (Online News Act) Regulations, Online News Regulatory Policy CRTC 2025-57, 26 February 2025, cost recovery charges under the Regulations can only fund the Commission’s work under the Act and cannot be used to fund work in broadcasting or telecommunications.
- Subsection 4(1) of the Regulations provides for the payment of an annual cost recovery charge by any applicable operator.
- Under section 5 of the Regulations, the Commission must publish a notice setting out the estimated costs to be incurred in a fiscal year that are attributable to the Commission exercising its powers and carrying out its duties and functions under the Act. For the 2025-2026 fiscal year (1 April 2025 to 31 March 2026), this amount is $2.719 million.
- The Regulations provide for an annual adjustment to ensure that only the Commission’s actual costs are recovered. As this is the first time cost recovery charges will be collected under the Regulations, there is no annual adjustment at this time. The annual adjustment for the 2025-2026 fiscal year will be published and applied next fiscal year.
- As such, the net billing for the Commission’s cost recovery charge for the 2025-2026 fiscal year is $2.719 million.
