Subject : Confirmation required under Broadcasting Decision 2025-201 and reporting deadline

Sylvain Lafrance,

Thank you for your letter of 3 September 2025 regarding the Talent Fund’s intention to file reports in accordance with the requirements set out in broadcasting regulatory decisions 2016-343, 2024-121 and 2024-121-1.

In your letter, you explained that, as a Crown corporation, Telefilm’s annual reports are confidential before being tabled by the Minister of Canadian Identity and Culture in the House of Commons, which makes it impossible to comply with the obligation to submit the report within three months of the end of the Talent Fund’s fiscal year. Since the timing of the tabling cannot be predicted in advance every year, you requested an extension to file the Talent Fund’s annual report and its audited financial statements to the Commission once they have been tabled in the House of Commons.

I recognize the specific statutory and confidentiality obligations that apply to Telefilm and understand the challenges these create in meeting the Commission’s filing deadline. I also acknowledge your request for an extension to align the filing of the Talent’s Fund’s annual report and financial statements with their tabling in the House of Commons, which typically occurs in the fall.

It is therefore reasonable that Telefilm be subject to certain flexibilities in the filing of its reports to the Commission. The Talent Fund’s annual report and financial statements are expected to be filed with the Commission each year as soon as practicable following their tabling in the House of Commons, and, where you are unimpeded by your statutory and confidentiality obligations, by no later than 30 November.

Additionally, based on the commitments outlined in your letter, Commission staff is of the view that the Talent Fund has met the requirements set out in Broadcasting Decision CRTC 2025-201. Accordingly, the Fund will be added to the list of Certified Independent Production Funds (CIPFs) eligible to receive contributions from audio-visual online undertakings pursuant to the Contribution Policy. This eligibility is effective as of the date of this letter.
