Subject: Application regarding unreasonable barriers to MVNO eligibility and refusal to provide mandated service by TELUS Communications Inc. – Further Procedural requests to consider new information
Dear Mr. Basra,
In letters dated 4 and 8 June 2026, Every-Day Computers Inc. (EDC) requests that the Commission consider new information in its deliberations on the above-mentioned Part 1 application. EDC submitted that this supplementary evidence, confirmation from Innovation, Science and Economic Development Canada (ISED) that the spectrum it currently holds supports the operation of a mobile wireless network, was newly available and material and that its inclusion would assist the Commission.
On 5 June 2026, TELUS Communications Inc. (TELUS) submitted that this information is not new evidence, but rather a statement of fact regarding the licence held by EDC. It added that the Commission should not permit the introduction of this evidence in contravention of section 24 of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure.
Commission staff notes that the characteristics of the spectrum licence EDC currently holds are already part of the record of the proceeding. Staff does not consider the information submitted by EDC to be new information that would assist the Commission’s deliberations of the issues raised in the above-noted application. The record of the proceeding is closed, and the application is presently under consideration by the Commission, which will render its decision in due course.
