AMENDMENT TO THE TELEVISION BROAD CASTING REGULATIONS - CHANGE IN IMPLEMENTATION OF THE NEW REPORTING PERIOD FOR THE MEASUREMENT OF CANADIAN CONTENT

On 8 May 1984, the Commission enacted amendments to the Television Broadcasting Regulations, effective 1 October 1984, which, among other matters, changed the reporting period for the measurement of Canadian content from an annual to a semi-annual basis.
In Public Notice CRTC 1984-194 dated 26 July 1984, in response to submissions from various representatives of the broadcasting industry, the Commission called for comments on the following proposed amendment to the Television Broadcasting Regulations:
The Commission revokes that portion of subsection 8(1) of the Television Broadcasting Regulations preceding paragraph(a) thereof, approved on 8 May 1984, and substitutes the following:
"8.(1) Subject to subsection (2) during the 12 month period commencing October 1, 1984 and there after during each subsequent six month period commencing October 1st and April 1st in each year, the total amount of time devoted by any station or network to the broadcasting of Canadian programs shall not"
In response to the public notice the Canadian Association of Broadcasters and nine television broadcasters submitted comments which supported the proposed one-year postponement of the implementation of the new semi-annual reporting period.
Accordingly, on the recommendation of the Executive Committee, the Commission on 27 September 1984, approved the amendment noted above. This amendment, enacted on 28 September 1984 (SOR/84-780), effectively postpones the implementation of the new semi-annual reporting period for the measurement of Canadian content for one year, to 1 October 1985 and re-introduces the previous twelve-month reporting period for the year 1 October 1984 to 30 September 1985.
Subsection 8(1) as amended is set out in the appendix attached to this notice.

APPENDIX
8.(1) Subject to subsection (2), during the 12 month period commencing October 1, 1984 and thereafter during each subsequent six month period commencing October 1st and April 1st in each year, the total amount of time devoted by any station or network to the broadcasting of Canadian programs shall not,
a) during the hours in the broadcast days in that period, be less than 60 per cent of the total time devoted to the broadcasting of programs by that station or network during those hours; or station
b) between the hours of six o'clock in the afternoon and midnight in that period
(i) in the case of the station or network for which the Commission has issued a public licence, be less than 60 percent of the total time devoted to the broadcasting of programs by that station or network ou during those hours, or
(ii) in the case of a station or network for which the Commission has issued a private licence, be less than 50 percent of the total time devoted to the broadcasting of programs by that station or network during those hours.
