Following a Public Hearing in London, beginning on 20 February 1990, the Commission approves the application for a licence to carry on an English- and Micmac-language FM community radio broadcasting transmitting undertaking in Restigouche on a frequency of 106.9 MHz (channel 295) with an effective radiated power of 31 watts. The licence will expire on 31 August 1992 and will be subject to the conditions specified in this decision and in the licence to be issued. This term will allow the Commission to consider the renewal of the licence following the review of native broadcasting, as announced in Public Notice CRTC 1990-12 dated 2 February 1990.
This authority will not be effective and the licence will not be issued until the Commission receives documentation establishing that the company has been incorporated in accordance with the application in all material aspects.
In accordance with the applicant's proposal and the Commission's policy statement on The Review of Community Radio (Public Notice CRTC 1985-194 dated 26 August 1985), the Commission will issue a special FM licence for community radio, Type B, for this station which will be operated in the Group IV music format.
In view of the fact that this non- profit corporation will be possibly supported in part by government loans or grants, the applicant is reminded that it should ensure that it retains full control over all management and programming decisions at all times.
The Commission notes that the applicant proposes to broadcast 4 hours 7 minutes of advertising over a 42-hour broadcast week. This exceeds the level authorized under the community radio policy for Type B stations. Consequently, it is a condition of licence that the applicant broadcast no more than an average of 4 minutes of advertising per hour per day, with a maximum of 6 minutes in any single hour.
The Commission notes that the applicant's Promise of Performance includes a commitment to broadcast 14% foreground and 49% combined foreground-mosaic programming. Under Commission policy, Type B special FM community stations are required to exceed the established quotas of 15% foreground and 50% combined foreground-mosaic programming. The Commission expects the applicant to exceed these minimum levels.
The Commission reaffirms the importance it attaches to the promotion of Canadian talent and notes that the applicant plans to broadcast Canadian native-language music and to sponsor live concerts as well as to broadcast Micmac-language music produced by local artists.
It is a condition of licence that the applicant adhere to the Canadian Association of Broadcasters' (CAB) self-regulatory guidelines on sex-role stereotyping, as amended from time to time and approved by the Commission.
It is also a condition of licence that the applicant adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.
It is a condition of licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
