Decision

Ottawa, 20 July 1990
Decision CRTC 90-667
CHUM Limited (MuchMusic Network)
Toronto, Ontario - 890913700
Pursuant to Public Notice CRTC 1990-52 dated 11 May 1990, the Commission approves the application by CHUM Limited (MuchMusic Network) (MuchMusic) to amend its condition of licence No. 10 regarding the definition of "broadcast day", as set out in section 2 of the Television Broadcasting Regulations, 1987, SOR 87/49, as amended, and "broadcast week" as defined in section 2 of the Radio Regulations, 1986, SOR/86-982, as amended.
Accordingly, condition of licence No. 10 has been amended as follows:
"broadcast day" means a 24 hour period beginning at 00:00:01 hour.
"broadcast week" means seven consecutive broadcast days beginning on a Friday".
In approving this application, the Commission has taken into consideration MuchMusic's arguments that under the current definition of "broadcast week", it must prepare its playlist five days before new releases are ready for distribution. The licensee further claimed that approval of this application will better enable it to achieve its required levels of Canadian content as well as French-language selections and to distribute new material as soon as possible. The Commission also notes that under the new definition of "broadcast day", MuchMusic's minimum Canadian content requirement will increase by 3 hours 37 minutes (from 60% of 18 hours to 60% of 24 hours).
The Commission informs the licensee that it is still required to abide by the condition of licence requiring MuchMusic to devote to the distribution of Canadian music videos and Canadian programs not less than 60% of the broadcast week and 50% of the time from 6:00 p.m. to midnight (Eastern time) during each broadcast week.
