Following a Public Hearing in Québec beginning on 5 March 1991, the Commission renews the broadcasting licence for CKRB Saint-Georges from 1 October 1991 to 31 August 1994, subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to assess the licensee's performance with regard to French-language popular music.
The Commission notes that the application (902648500) for renewal of CIRB Lac Etchemin's licence was also on the agenda of the above-noted public hearing. However, following the public hearing, the licensee decided to surrender this licence. In Decision CRTC 91-311 dated 14 May 1991, the Commission revoked the licence for CIRB Lac Etchemin.
Subsections 8(5) and 8(6) of the Radio Regulations, 1986 (the regulations) require each licensee to retain, for a period of at least four weeks from the date of broadcast and furnish to the Commission upon request "a clear and intelligible tape recording or other exact copy of all matter broadcast". In this regard, the Commission requested the station's logger tapes of the programming broadcast by CKRB on 7 February 1990. The licensee informed the Commission that, due to human error, the logger tape for 7 February was not available. In lieu of that tape, it submitted the logger tape for 6 February 1990, which indicated a state of non-compliance with regard to the level of French-language popular music. The licensee explained that it was in the process of computerizing its musical programming and that it plans to modify its evening programming, which should enable it to attain the prescribed level of 65%.
The Commission is seriously concerned about the licensee's failure to comply with the provisions of the regulations. The Commission will monitor the licensee's performance, and expects the licensee to demonstrate that it has taken appropriate measures to ensure, at all times, full compliance with its commitments and with regulatory requirements.
The Commission wishes to emphasize once again the particular importance it places on the development of Canadian talent, and it notes the licensee's planned initiatives and commitments in this area. The Commission expects the licensee to take all necessary steps to honour its commitments as soon as its financial situation improves.
It is a condition of licence that the licensee adhere to the guidelines on sex-role portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-Role Portrayal Code for Television and Radio Programming, as amended from time to time and approved by the Commission. It is also a condition of licence that the licensee adhere to the provisions of the CAB's Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.
