Following a Public Hearing in Regina beginning on 23 October 1990, the Commission renews the Class 2 licence for the broadcasting receiving undertaking serving Dauphin, held by Westman Media Co-operative Ltd., from 1 September 1991 to 31 August 1996. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, WTVS (PBS), WDIV (NBC), WJBK-TV (CBS) and WXYZ-TV (ABC) Detroit, Michigan, received via satellite from the CANCOM network, as part of the basic service.

The Commission notes that the licensee will continue to distribute the programs prepared by Manitoba Educational Television on the community channel at times when community programming is not being distributed. Should the programming prepared by Manitoba Educational Television conflict with the community programming, the licensee is reminded that priority must be accorded to community programming.

As part of the renewal application, the Commission considered the licensee's request to be relieved, by condition of licence, of the requirement of subparagraph 16(2)(c)(i) of the regulations to distribute the programming service of a French-language AM or FM station owned and operated by the Canadian Broadcasting Corporation that is received over-the-air or via satellite or microwave relay. In light of the low penetration of subscribers to its radio service and in the absence of any interventions opposing this proposal from subscribers, the Commission approves the licensee's request.

The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. The Commission encourages the licensee to continue its efforts to develop community programs that reflect subscriber interests and concerns.

It is a condition of licence that the licensee be relieved of the requirement of section 4 of the regulations to own and operate amplifiers and the outside wiring portion of the subscriber drops.
