Following a Public Hearing in the National Capital Region beginning on 27 November 1990, the Commission approves the application for a licence for an FM radio broadcasting transmitting undertaking at Rivière-du-Loup on the frequency 89.5 MHz, channel 208, with an effective radiated power of 100,000 watts to rebroadcast the programs of CJBR Rimouski. The Commission notes that in its original application, announced in Notice of Public Hearing 1990-13 dated 28 September 1990, the Canadian Broadcasting Corporation proposed to rebroadcast the programming originating at CBV Québec.

The Commission will issue a licence expiring 31 August 1994, subject to the conditions specified in the licence to be issued. This term will enable the Commission to consider the renewal of this licence at the same time as that of the originating station CJBR Rimouski.

The Commission notes that this application addresses the concerns set out in Decision CRTC 90-210 dated 28 February 1990, wherein the Commission expected the CBC to find a means to ensure that listeners in the Rivière-du-Loup area continue to receive its national French-language radio service upon the disaffiliation of CHGB La Pocatière and its rebroadcaster CHAL Saint-Pamphile.

The Commission authorizes CBC to make use of the Subsidiary Communications Multiplex Operation. The Commission expects CBC to adhere to the guidelines set out in Appendix A to Public Notice CRTC 1989-23 dated 23 March 1989 entitled Services Using the Vertical Blanking Interval (Television) or Subsidiary Communications Multiplex Operation (FM). This authority may only be implemented when the Department of Communications gives the technical approval required by the Radiocommunication Act and regulations made thereunder.

The Department of Communications (DOC) has advised the Commission that this application is conditionally technically acceptable, and that a Broadcasting Certificate will only be issued once it has been determined that the undertaking's proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

In accordance with paragraph 13(1)(b) of the Broadcasting Act, the Commission will only issue the licence, and the authority granted herein may only be implemented, at such time as written notification is received from the DOC that its technical requirements have been met, and that a Broadcasting Certificate will be issued.

The Commission notes the 15 interventions received in response to this application. While the interveners expressed support for the CBC's proposal to offer radio service in the Kamouraska, Rivière-du-Loup, Témiscouata and Basques areas. They requested, however, that the new station rebroadcast the programming originating at CJBR Rimouski rather than CBV Québec because that station's programming better reflects the interests of the area. The interveners also suggested that the CBC should assign teams of reporters to the area on a permanent basis in order to provide adequate regional coverage.

As a result of the interventions filed, the CBC amended its application herein approved, the effect being that the FM station at Rivière-du-Loup will rebroadcast the programming of CJBR Rimouski rather than that of CBV Québec. The CBC indicated, however, that it does not have the financial resources to permanently assign reporters to the Rivière-du-Loup area, but will send reporters from Rimouski to cover local events, and will also make use of local resources.
