Approval of a licence amendment authorizing the distribution of additional services on the radio-communication distribution undertaking serving Hay River; denial of an application for a licence to carry on a new cable distribution undertaking at that community
Following a Public Hearing held in Saskatoon beginning on 6 June 1994, the Commission approves the application by the Hay River Community Service Society (the Society) to amend the licence for the radiocommunication distribution undertaking (RDU) serving Hay River by adding the authorization to distribute, in non-encrypted mode, Allarcom Pay Television Ltd. (Superchannel) on channel 4, with a transmitter power of 10 watts, and The Family Channel on channel 16, with a transmitter power of 20 watts.
The Commission denies the Society's application for a licence to carry on a cable distribution undertaking to serve Hay River.
The above-noted applications were considered in conjunction with an application filed by Northwestel Inc., representing a company to be incorporated (Northwestel), for a licence to carry on a cable undertaking to serve Hay River. At the Saskatoon hearing, the Society and Northwestel were given the opportunity to intervene against each other's application.
In Decision CRTC 94-706 released today, the Commission has denied Northwestel's application for a cable licence to serve Hay River, as well as its related applications to provide cable service to a number of other communities in the Yukon and Northwest Territories. The Commission indicated, however, that it would be prepared to deal expeditiously with applications containing a comprehensive plan, including firm commitments and a time-table, to provide cable service to the many small, isolated communities across the North.
In light of the possibility of a subscription-based undertaking being licensed to serve Hay River sometime in the future, the Commission reminds the licensee that it is required, by condition of licence, to cease the non-encrypted distribution of all non-Canadian services if and when so ordered by the Commission.
At the hearing, the Society advised the Commission that it had submitted its application for a cable licence to serve Hay River only as a "defensive" response to Northwestel's application. Moreover, the Society stated that its preferred option would be for the Commission to deny Northwestel's application, approve the Society's application to expand the programming services offered by the existing RDU, and treat its own separate application for a licence for a cable undertaking as withdrawn.
In support of its application for an amendment to its existing licence, the Society stated that, in a plebiscite, a majority of Hay River's residents voted to add Superchannel and The Family Channel to the community's established RDU.
The Society also noted that the operation of the RDU is funded from the property taxes paid by local residents.
The Commission acknowledges the intervention submitted by the Town of Hay River in support of the Society's applications.
