IN THE MATTER OF an application by Bell Advanced Communications Inc. (BAC) dated 3 January 1996, for exemption from contribution charges for dedicated voice services (dedicated to individual users) in Bell Canada's (Bell) territory.

WHEREAS BAC stated that it is solely a data and dedicated services provider and does not provide joint-use voice services to its customers;
WHEREAS BAC stated that Bell, as the provider of the underlying services, can verify that the services are dedicated in its territory;
WHEREAS by letter dated 29 March 1996, Stentor Resource Centre Inc. (Stentor) replied that Bell has reviewed the service configurations involved, and confirmed that the services identified by BAC are dedicated to individual users;
WHEREAS Stentor agreed with the requested exemption for dedicated services;
WHEREAS Stentor noted, however, that BAC had previously applied for an exemption from contribution charges for data services provided in Bell and BC TEL territories, which was approved in Telecom Order CRTC 96-64, 23 January 1996 (Order 96-64), and that the supporting evidence for that exemption was an affidavit affirming that BAC was a data-only service provider;
WHEREAS Stentor submitted that, given that BAC is apparently no longer a data-only service provider, the affidavit submitted in support of the earlier application is no longer valid;
WHEREAS Stentor submitted that an alternative form of evidence is required to support the continuation of the data exemption;
WHEREAS Stentor stated that Bell has confirmed that it can provide carrier verification, that the services previously exempted are configured such that they can only be used for data services to support the exemption from contribution charges previously granted to BAC for data services provided in Bell's territory;
WHEREAS by letter dated 21 June 1996, Stentor submitted an affidavit dated 20 June 1996 from BC TEL Advanced Communications which described the configuration, stated that the circuits in question are resold by BC TEL Advanced Communications, and confirmed that BC TEL Advanced Communications uses the circuits solely for the provision of data services and does not offer voice services; and
WHEREAS the Commission finds that the evidence for these circuits in question meets the Commission evidentiary requirements as set out in Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993 -
IT IS HEREBY ORDERED THAT:
1. The exemption for the dedicated voice circuits in Bell's territory is approved effective 3 January 1996.
2. The continuation of exemption for the data circuits in Bell's territory (previously approved in Order 96-64) is approved.
3. The continuation of exemption for the data circuits in BC TEL's territory (previously approved in Order 96-64) is approved.
