Telecom Order CRTC 97-287
IN THE MATTER OF an application by Simcoe County Long Distance Corporation (Simcoe) received by fax on 8 January 1997, requesting an exemption from contribution charges for services used exclusively by one customer for the making of voice and data calls.

WHEREAS in support of its application, Simcoe provided an affidavit dated 11 December 1996 specifying the services involved and affirmed that the services are dedicated to the use of a single customer (Simcoe also provided a diagram describing the configuration);
WHEREAS by letter dated 10 February 1997, Bell Canada (Bell) noted that, in support of exemptions for dedicated circuits, the Commission's evidentiary requirements are carrier verification, an end-user affidavit, or a technical audit;
WHEREAS accordingly, Bell submitted that the affidavit provided by Simcoe does not satisfy the evidentiary requirements in this case;
WHEREAS Bell noted, however, that it can confirm the description of the configuration provided by Simcoe, and can verify that the service arrangements are such that all calls carried by the system must terminate at the end-user's Centrex systems;
WHEREAS accordingly, Bell agreed with the requested exemption;
WHEREAS the Commission notes that Simcoe's affidavit is not the end-user's affidavit and therefore does not satisfy the Commission's evidentiary requirements according to Applications for Contribution Exemptions, Telecom Decision CRTC 93-2, 1 April 1993; and
WHEREAS however, Bell has provided carrier verification which does satisfy the Commission's evidentiary requirements -
IT IS HEREBY ORDERED THAT:
Simcoe's application is approved effective the date of the affidavit (11 December 1996).
