Public Notice

Ottawa, 19 March 1999
Public Notice CRTC 1999-48
Lac-Sat Communications Ltd.
The Commission has received the following applications:
1. ACROSS CANADA
Applications (199811641, 199811659, 199811625, 199811633, 199811667) by ALLIANCE ATLANTIS COMMUNICATIONS INC., on behalf of History Television Inc., Showcase Television Inc., Life Network Inc./Réseau Life Inc., HGTV Canada Inc. and Alliance Communications Corporation and Shaw Communications Inc., on behalf of a general partnership (Alliance/Shaw VOD Partnership), for authority to effect changes of ownership and control of Alliance Communications Corporation ("Alliance") and Atlantis Communications Inc. ("Atlantis") of their broadcasting undertakings as they were reorganized pursuant to a plan of arrangement.
Until the Commission approves the transactions, Alliance Atlantis Communications Inc. ("Alliance/Atlantis") have put in place respective trust arrangements permitting the transfer of shares and partnership interests of Alliance and Atlantis to the new merged corporate entity.
If the transactions are authorized Alliance/Atlantis would own and control Alliance broadcasting undertakings (History Television Inc., Showcase Television Inc., Alliance/Shaw VOD Partnership) and Atlantis broadcasting undertakings (Life Network Inc./Réseau Life Inc., HGTV Canada Inc.).
The Commission also notes that Alliance/Atlantis has a significant involvement in the television program production and distribution industries.

Applications (199807492, 199807500) by ROGERS BROADCASTING LIMITED ("Rogers") 36 Victoria Street, Toronto, Ontario, M5C 1H3, for authority to acquire the issued and outstanding shares of CHEZ-FM Inc., licensee company for three radio stations in Eastern Ontario: CHEZ-FM Ottawa, CFMO-FM and CJET-AM Smiths Falls.
If the transaction is authorized, Rogers would own three commercial radio stations in Ottawa; CKBY-FM, CHEZ-FM and CIWW-AM. In addition, Rogers, through affiliate companies, is also the incumbent cable distributor for the Ottawa market and has a television presence via the multilingual and multicultural television station (CFMT-TV-2).
In the Commission's common ownership policy established in Public Notice CRTC 1998-41 "Commercial Radio Policy 1998" ("the radio policy"), it stated that in markets with eight or more radio stations operating in a given language, a single owner may be permitted to own or control as many as two AM and two FM stations in a given language. However, the Commission indicated that it will take into consideration the impact on competition and the diversity of news voices in a market whenever the proposed purchaser has media cross-ownership and multiple local radio stations in the market.
