Conversion of AM station
CKFL to FM

 

The Commission approves the application for a French-language FM radio station at Lac Mégantic to replace AM station CKFL. The terms and conditions of licence are set out in the appendix to this decision.

 

The proposed service

1.

The new station will retain the actual format which consists predominantly of music. In the area of news, public affairs and spoken word programming, the applicant made a commitment to maintain the local programming presently broadcast on the AM station. As the station will no longer be affiliated to the réseau des Appalaches, the entire FM programming will be locally produced.

2.

The applicant stated that the proposed conversion to the FM band is aimed at offering an acceptable quality signal day and night.

3.

With respect to the development of Canadian talent, the applicant will continue to contribute $894 annually, until 31 August 2003, as benefits related to the acquisition of assets approved in Decision CRTC 98-475. This amount is in addition to participation in the Canadian talent development plan of the Canadian Association of Broadcasters.

The applicant has requested authority to broadcast simultaneously on the AM and FM bands for a period of 90 days. A condition of licence to this effect is set out in the appendix to this decision.

5.

The Commission notes the interventions filed by Groupe Radio Astral and Association québécoise de l'industrie du disque, du spectacle et de la vidéo (ADISQ) in opposition to this application, and is satisfied with the licensee's reply to these interventions.

Appendix to Decision CRTC 2000-757

 

Terms of the licence for the FM radio programming undertaking at Lac Mégantic

 

A licence will be issued and effective when the licensee confirms in writing that it is ready to begin operation. This must take place within 12 months of today's date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period.

 

The Department of Industry has advised the Commission that this application is conditionally technically acceptable, subject to determination that there is no unacceptable interference with NAV/COM services. When the Department certifies that a broadcasting certificate will be issued, the Commission will issue the licence and the licensee may begin operation (section 22(1) of the Broadcasting Act).

 

The licence, when issued, will expire on 31 August 2007.

 

The station will broadcast on the FM band, on the frequency 106.7 MHz, channel 294A. The Department of Industry has advised that the undertaking will have an effective radiated power of 4,250 watts rather than 5,000 watts, as indicated in Notice of Public Hearing CRTC 2000-7 dated 14 July 2000.

 

The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources
(PN 1992-59).

 

Conditions of licence

 

The licence will be subject to the conditions specified in the licence to be issued, as also set out in Public Notice CRTC 1999-137. The licence will also be subject to the following condition:

 

The licensee is authorized to simulcast the programming of CKFL on the new FM station for a transition period of 90 days following implementation. At the end of this period, the Commission expects the licensee to surrender the AM licence for cancellation by the Commission.
