Acquisition of assets

1. 9;

The Commission approves the application by Midmusq Enhancements Inc. for authority to acquire the assets of the cable distribution undertaking serving the above-noted localities, from Streatch Communications Incorporated, and for a broadcasting licence to continue the operation of this undertaking.

2. 9;

The Commission will issue a Class 3 licence to Midmusq Enhancements Inc., expiring 31 August 2006, upon surrender of the current licence. The operation of this undertaking will be regulated pursuant to the Broadcasting Distribution Regulations. The licence will be subject to the condition specified in this decision and to any other condition that may be specified in the licence to be issued.

3. 9;

The licensee is also authorized, by condition of licence, to distribute in encrypted mode the programming service of the Atlantic Satellite Network (ASN), provided that it is distributed on an unrestricted channel of the basic service.

4. 9;

The signals that the licensee is authorized to distribute may be received by direct reception, or from any Canadian broadcasting distribution undertaking (licensed or exempted) which is authorized to provide signals to other distributors.

5. 9;

It is a condition of licence that, for community programming and any other programming of a service that it originates, the licensee adhere to the guidelines on the depiction of violence in television programming set out in the Canadian Association of Broadcasters' Voluntary code regarding violence in television programming, as amended from time to time and approved by the Commission.

6. 9;

The Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources (Public Notice 1992-59).

7. 9;

The Commission notes that a transaction between Mr. Streatch and Streatch Communications Incorporated (Decision CRTC 2001-188 issued today) was effected in order to facilitate the takeover that is the object of this decision.
