ExaTEL's proposed general tariff

The Commission approves, on an interim basis, with the changes listed below, ExaTEL's proposed general tariff to establish general terms and conditions, and access services.

ExaTEL Inc. filed an application for approval of its general tariff (CRTC Tariff 21440), which includes general terms and conditions, and provisions and rates for access services for interconnection with local exchange carriers (LECs), interexchange service providers (IXSPs) and wireless service providers (WSPs). ExaTEL filed the application on 27 July 2001.

The Commission notes that ExaTEL's tariff requires amendments to reflect recent Commission determinations concerning contribution and basic listing interchange file (BLIF) service.

ExaTEL has not included provisions in its tariff for the provision of 9-1-1 Emergency Response Service (ERS) to municipalities. Competitive local exchange carriers (CLECs) are expected to enter into agreements with municipalities for the provision of 9-1-1 ERS. The Commission notes, however, that a tariff can govern the relationship between a CLEC and a municipality for the provision of 9-1-1 ERS in the absence of an agreement.

In addition, ExaTEL's tariff requires a number of minor amendments for the purpose of correcting various provisions.

In light of the foregoing, the Commission orders that:

(a) The proposed tariffs are approved on an interim basis, with the following changes:

(i) amend item 202 as follows:

· in the first sentence of sub-item (1), replace the words "only to LECs operating in Canada" with "to LECs and Independent Telephone Directory Publishers"; and

· in sub-item (5) add the words "and Independent Telephone Directory Publishers" immediately after the acronym "LEC";

(ii) in item 300, General, delete the last sentence in the first paragraph;

(iii) in item 400, General, delete the third sentence in the paragraph;

(iv) amend item 401 as follows:

· in sub-item (2), delete the word "try" and add the words "standards established by Industry" immediately after the word "interface"; and

· in sub-item (3) add the following immediately after the words "requested and at": "the locations specified by the WSP. ExaTEL shall, however, devote its"; and

(v) delete all provisions in part E.

(b) ExaTEL is to issue forthwith revised tariff pages incorporating the changes set out above.

(c) ExaTEL is directed to file forthwith its PIC/CARE (primary interexchange carrier/customer account record exchange) handbooks and an unexecuted copy of its BLIF agreement for approval.
