Re: Review - Legal Directorate's Guidelines for the Taxation of Costs

This is in response to your letter dated 6 January 2006 requesting a review of the rates set out in Appendix A of the Legal Directorate's Guidelines for the Taxation of Costs, 15 May 1998 (the current rates).

In your letter you requested directions as to the appropriate list of parties to whom you should be serving copies of your request. The Legal Directorate considers it would be appropriate to serve copies on all parties who participated in the process which led to the current rates, as well as those parties who have participated in cost proceedings since 2002. Enclosed please find a list of the parties that should be served, including those parties you indicate you have already copied.

In addition, you will find in both official languages, the process for comments and reply by all parties on whether and to what extent, if any, changes should be made to Appendix A of the Legal Directorate's Guidelines for the Taxation of Costs, 15 May 1998 . You should serve a copy of your 6 January 2006 request, along with a copy of this letter and the document setting out the process, on the parties set out in the list, no later than 13 February 2006 .

PROCESS

  1. The Legal Directorate of the Canadian Radio-television and Telecommunications Commission is calling for comments on whether and to what extent, if any, changes should be made to Appendix A of the Legal Directorate's Guidelines for the Taxation of Costs, 15 May 1998, including comments in reference to the Public Interest Advocacy Centre's (PIAC) proposal dated 6 January 2006.

  2. All parties wishing to participate in this process are required to notify the Legal Directorate of their intention by 20 February 2006 (the registration date). They may do so by contacting Paul Menard by fax at (819) 953-0589 or by e-mail at paul.menard@crtc.gc.ca . Parties are expected to participate in the process by way of electronic means. Parties that do not have access to the Internet are to provide their mailing address and indicate whether they wish to receive copies of the submissions on disk or in hard copy.

  3. The Legal Directorate will issue, by 27 February 2006 , a complete list of participating parties and their e-mail or mailing addresses, identifying those parties who wish to receive disk versions or hard copy filings.

  4. Comments are to be filed with the Legal Directorate no later than 6 March 2006 , with copies served on all participating parties.

  5. Parties may reply to comments made by all other participating parties. Replies must be filed with the Legal Directorate no later than 20 March 2006, with copies served on all participating parties.

  6. Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.

  7. The Legal Directorate will not formally acknowledge comments.

  8. Submissions longer than five (5) pages should include a summary.

  9. Each paragraph of submissions should be numbered.

  10. Where the submission is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document as an indication that the document has not been damaged during electronic transmission.

  11. Note that all information that you provide as part of this process, except information granted confidentiality, becomes part of a publicly accessible file. This information includes your personal information, such as your full name, e-mail address, postal/street address, telephone and facsimile number(s), and any other personal information you provide.

  12. The personal information you provide will be used and may be disclosed for the purpose for which the information was obtained or compiled by the Commission, or for a use consistent with that purpose.
