Low-power Religious FM station in Grand Falls/Windsor

1.

The Commission approves the application by the Windsor Pentecostal Church for a broadcasting licence to operate a non-commercial, low-power, English-language FM radio programming undertaking to provide religious programming in Grand Falls/Windsor. The station will operate at 103.5 MHz (channel 278LP) with an effective radiated power of 50 watts.

The station will broadcast a minimum of six to eight hours of programming in each broadcast week. The programming will consist solely of religious services including masses, weddings, funerals, baptisms and other similar religious celebrations, with the exception of programs or program segments it produces for the purpose of ensuring balance on matters of public concern. The station will not broadcast commercial messages.

The applicant confirmed that the station would not broadcast the programming of any other programming undertaking and that it would adhere to the Commission's guidelines on balance and ethics as contained in Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993 (Public Notice 1993-78). In that policy, the Commission stated that stations that broadcast religious programming have an obligation to offer differing views on matters of general public concern, including religious matters.

The Commission did not receive any interventions in connection with this application.

The licence will expire 31 August 2013. It will be subject to the conditions of licence set out in the appendix to this decision.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the applicant that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Given that the technical parameters approved in this decision are for a low-power unprotected FM service, the Commission also reminds the applicant that it will have to select another frequency if the Department so requires.

Furthermore, the licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 16 January 2009. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before that date.

Conditions of licence

 

1. The licensee shall broadcast programming consisting solely of religious services, including masses, weddings, funerals, baptisms and other similar religious celebrations, with the exception of programs or program segments it produces for the purpose of ensuring balance on matters of public concern. Such programs or program segments shall also comply with guidelines (i) to (iv) contained in section III.B.2a) of Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993 (Public Notice 1993-78).

 

2. The licensee shall adhere to the guidelines on ethics for religious programming, as set out in section IV of Public Notice 1993-78, as amended from time to time.

 

3. The licensee shall not solicit or broadcast commercial messages.

 

4. The licensee shall not broadcast the programming of any other programming undertaking.
