Licence renewals

1.

The Commission renews the broadcasting licences for the English-language commercial radio programming undertakings listed below from 1 January 20091 to 31 August 2015. These licences will be subject to the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999, with the exception of condition 5 and of condition 1, which is replaced by the following condition:

If the licensee originates 42 or more hours of programming in any broadcast week, the licensee shall adhere to the Canadian Association of Broadcasters' Equitable Portrayal Code, as amended from time to time and approved by the Commission. However, the application of the foregoing condition of licence will be suspended if the licensee is a member in good standing of the Canadian Broadcast Standards Council.

The Commission reminds the licensees that they are required to adhere to the requirements relating to contributions to Canadian content development set out in section 15 of the Radio Regulations, 1986, as amended by Regulations Amending the Radio Regulations, 1986, SOR/2008-177, 28 May 2008, announced in Broadcasting Public Notice 2008-67.

With respect to CIBH-FM Parksville, the Commission notes its determination in Broadcasting Decision 2006-263 that the benefit expenditures associated with the transaction approved therein would be made in accordance with the proposed allocations, as set out in the appendix to that decision. Accordingly, the Commission expects the licensee to file a report at the conclusion of the seven-year benefit period detailing the manner in which the tangible benefits have been expended.

With respect to CKCK-FM Regina, the Commission notes that as set out in Decision 2001-741, the licensee was required, by condition of licence, to make payments to third-party organizations dedicated to the promotion of Canadian artists in the proportions indicated in the Canadian Association of Broadcasters' guidelines on the funding of Canadian talent development (CTD), as announced in Public Notice 1995-196. The Commission notes that Rawlco Radio Ltd. did not make its CTD contribution in the amount of $3,000 for the broadcast year ending 31 August 2002. Accordingly, in the broadcast year ending 31 August 2009, the licensee shall, by condition of licence, expend a minimum of $3,000 to support the development of Canadian talent in fulfillment of its outstanding commitment to CTD. This amount is in addition to the contributions to Canadian content development required under section 15 of the Radio Regulations, 1986, as amended by Regulations Amending the Radio Regulations, 1986, SOR/2008-177, 28 May 2008, announced in Broadcasting Public Notice 2008-67.
 

Employment equity

6.

Because these licensees are subject to the Employment Equity Act and file reports concerning employment equity with the department of Human Resources and Social Development Canada, their employment equity practices are not examined by the Commission.
