Re:   Part VII application by Shaw Cablesystems Limited seeking an order granting access to highways and other public places in the County of Wheatland, Alberta

The Commission received a comment by Alberta One-Call Corporation (Alberta One-Call) dated 21 April 2008 on the above application.

Commission staff notes that the Part VII application was filed on 19 November 2007 and the comment period of 30 days ended on 19 December 2007. Commission staff also notes that, on 18 December 2007, Alberta One-Call filed its comments on the application.

In letters dated 22 February 2008 and 2 April 2008, Commission staff suspended the above Part VII application to allow for the disputing parties, Shaw Cablesystems Limited and Wheatland County , to negotiate. Subsequent to negotiations, the disputing parties were requested to file their comments and reply comments by 9 April 2008 and 11 April 2008 respectively.

Commission staff considers Alberta One-Call's submission, dated 21 April 2008 , was filed out of process. Accordingly, Alberta One-Call's submission dated 21 April 2008 will not form part of the record of this proceeding and will therefore not be considered by the Commission in its deliberations.
